38 <br /> <br />A RESOLUTION GRANTING A USE PERMIT TO BASIL F. GRAY, III AND <br />PHILLIP M. GRAY FOR THE CONVERSION OF AN EXISTING SINGLE- <br />FAMILY DWELLING TO A DUPLEX RESIDENCE AT 106 LONDON BOULEVARD. <br /> <br /> WHEREAS, Basil F. Gray, III and Phillip M. Gray have made <br />application pursuant to ~40-102 (B) of the Code of the City of <br />Portsmouth, Virginia for a use permit to convert an existing <br />single-family residence to a duplex residence at 106 London <br />Boulevard (Tax Map 2, Parcel 8) which is located in the Olde <br />Towne Historic District; and <br /> <br /> WHEREAS, the applicant and the <br />done all things required to be done <br />application; and <br /> <br />Planning Director have <br />in connect~ion with said <br /> <br /> WHEREAS, the Planning Commission has recommended the <br />granting of a use permit, with conditions, for the conversion <br />of an existing single-family dwelling to a duplex residential <br />structure. <br /> <br /> NO~, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia: <br /> <br />1. That the use for which the use permit is sought: <br /> <br /> (a) Will not adversely affect the health and safety <br />of persons residing In the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or <br />injurious to the property or improvements in the neighborhood; <br />and <br /> <br /> (c) Will be in accord with the purposes of the <br />Zoning Chapter of the City Code. <br /> <br /> 2. Basil F. Gray, III and Phillip M. Gray are hereby <br />granted a use permit pursuant to ~40-102 (B) to convert an <br />existing single-family residence to a duplex residential <br />structure at 106 London Boulevard, such conversion to be in <br />compliance with the regulations applicable to the Olde Towne <br />Historic Residential District as provided for in the Zoning <br />Chapter of the Code of the City of Portsmouth, Virginia, 1973, <br />as amended, such approval being granted subject to the <br />following terms and conditions: <br /> <br /> (a) The applicant shall comply with all applicable <br />codes, ordinances, policies and requlations of the City of <br />Portsmouth, Virginia, and shall obtain all necessary licenses <br />and permits. <br /> <br /> <br />
