38 A RESOLUTION GRANTING A USE PERMIT TO BASIL F. GRAY, III AND PHILLIP M. GRAY FOR THE CONVERSION OF AN EXISTING SINGLE- FAMILY DWELLING TO A DUPLEX RESIDENCE AT 106 LONDON BOULEVARD. WHEREAS, Basil F. Gray, III and Phillip M. Gray have made application pursuant to ~40-102 (B) of the Code of the City of Portsmouth, Virginia for a use permit to convert an existing single-family residence to a duplex residence at 106 London Boulevard (Tax Map 2, Parcel 8) which is located in the Olde Towne Historic District; and WHEREAS, the applicant and the done all things required to be done application; and Planning Director have in connect~ion with said WHEREAS, the Planning Commission has recommended the granting of a use permit, with conditions, for the conversion of an existing single-family dwelling to a duplex residential structure. NO~, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit is sought: (a) Will not adversely affect the health and safety of persons residing In the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood; and (c) Will be in accord with the purposes of the Zoning Chapter of the City Code. 2. Basil F. Gray, III and Phillip M. Gray are hereby granted a use permit pursuant to ~40-102 (B) to convert an existing single-family residence to a duplex residential structure at 106 London Boulevard, such conversion to be in compliance with the regulations applicable to the Olde Towne Historic Residential District as provided for in the Zoning Chapter of the Code of the City of Portsmouth, Virginia, 1973, as amended, such approval being granted subject to the following terms and conditions: (a) The applicant shall comply with all applicable codes, ordinances, policies and requlations of the City of Portsmouth, Virginia, and shall obtain all necessary licenses and permits.
