A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT <br />PURSUANT TO SECTION 40-55 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA, 1973, SAID PROJECT CONSISTING OF <br />SEVENTY-FIVE RENTAL APARTMENT UNITS ON 5.29 ACRES OF LAND ON <br />THE WEST SIDE OF TEJO LANE. <br /> <br /> WHEREAS, Benjamin J. Levy, on behalf of Churchland Forest <br />II Associates, has made application pursuant to ~40-55 of the <br />Code of the City of Portsmouth, Virginia, 1973, as amended, <br />for the granting and approval of a group housing project <br />consisting of seventy-five (75) rental apartment units on a <br />5.29 acre parcel west of Tejo Lane adjacent to the <br />Chesapeake/Portsmouth corporate limits boundary and further <br />described as Tax Map 831, Parcels 21 and 22, and Tax Map 833, <br />Parcel 2, such group housing project having been designated as <br />GHP-88-7; and <br /> <br /> WHEREAS, the application has been determined by the <br />Planning Commission to have met the requirements of said <br />~40-55 and the Planning Commission has reviewed such <br />application, site plans, elevations and interior plans <br />submitted therewith and has recommended approval of said <br />application; and <br /> <br /> ~EREAS, the developer has been informed that approval of <br />a group housing project pursuant to ~40-55 grants only an <br />exemption from certain requirements for residences as stated <br />in said section and does not constitute a waiver of any other <br />requirement embodied in the Subdivision Ordinance, Zoning <br />Ordinance, Code of the City of Portsmouth, Virginia, or any <br />other applicable local, state or federal law or regulation; <br />and <br /> <br /> WHEREAS, the developer is aware that building permits or <br />any other required permit will be issued only upon compliance <br />with the ordinances, laws, or regulations applicable thereto. <br /> <br /> NO%~, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia, that the certain group housing <br />project specifically designated as GHP-88-7 and more <br />specifically described on plans filed with the appropriate <br />officials of the City of Portsmouth, Virginia, such plans and <br />documentations in support thereof being made a part hereof is <br />hereby granted approval subject to the following terms and <br />conditions: <br /> <br /> (1) Needed drainage easements must be obtained from the <br />owners of the apartment complex to the north. <br /> <br /> (2) A full hydrological <br />submitted to and approved by <br />to final site plan approval. <br /> <br /> study for the site must be <br />the Engineering Department prior <br /> <br /> <br />
