A RESOLUTION G~RANTING A USE PERMIT TO THE NEW MOUNT ZION CHURCH OF GOD IN CHRIST TO OPERATE A CHURCH AND PLACE OF WORSHIP AT 1224 CAVALIER BOULEVARD. WHEREAS, Thomas Goodwyn, Trustee, of the New Mount Zion Church Of God In Christ, has made application pursuant to S40-70 (b) of the Code of the City of Portsmouth, Virginia, 1973, for the granting of a use permit as hereinafter-described; and %~HEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of a use permit with conditions for the operation of a church and place of worship. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. The use for which the use permit hereinafter-described is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to injurious to the property or improvements neighborhood; and the public use or in the (c) ~ill be in accordance with the purposes of the Zoning Chapter of the City Code. 2. The New Mount Zion Church of God In Christ is hereby granted a use permit pursuant to ~40-70 (b) of the Code of the City of Portsmouth, Virginia, to operate a Church and place of worship on property designated as 1224 Cavalier Boulevard which consists of approximately .570 acres of land and is described as Tax Map 548, Parcel 36 (UP-88-15). 3. This use permit is approved subject to the following conditions: (a) Occupancy of the Church will be limited to a maximum of one hundred (100) persons at any one time. (b) Underground gasoline storage tanks must be removed in accordance with the requirements of the Bureau of Fire Prevention.
