A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT PURSUANT TO SECTION 40-55 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, CONSISTING OF SIX APARTMENTS IN A MIXED USE DEVELOPMENT AT 1927 HIGH STREET. WHEREAS, Quarter Century Corporation, by Kirk Berkley, has made application pursuant to ~40-55 of the Code of the City of Portsmouth, Virginia, 1973, as amended, for the granting and approval of a group housing project consisting of six (6) apartments to be developed in a mixed use development at 1927 High Street, such premises further described as Tax Map 169, Parcels 7, 8, 21 and 9.1, and such group housing project having been designated as GHP-88-6 and consisting of two (2) units on the first floor and four (4) units on the second floor within the structure on the property; and WHEREAS, the application has been determined by the Planning Commission to have met the requirements of ~40-55 of the Code of the City of Portsmouth, Virginia, 1973, as amended, and the Planning Commission has reviewed such application and site plan submitted therewith and has recommended a conditional approval of said application; and WHEREAS, the developer has been informed that approval of a group housing project pursuant to ~40-55 grants only an exemption from certain requirements for residences as stated in said section, and does not constitute a waiver of any other requirement embodied in the Subdivision Ordinance, Zoning Ordinance, Code of the City of Portsmouth, or any other applicable local, state or federal law or regulation; and WHEREAS, the developer is aware that building.permits or any other required permit be issued only upon compliance with the ordinances, laws, or regulations applicable thereto. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the certain group housing project described above and designated as GHP-88-6 and more specifically described by correspondence from Kirk Berkley, AIA, as shown on plans filed with the appropriate officials of the City of Portsmouth, Virginia, such correspondence and plans being made a part hereof, is hereby granted approval subject to the following terms and conditions: (1) A certificate of compliance for the final plans must be obtained from the DowntownIDesign Committee prior to issuance of building permits. (2) Landscaping shall be installed as shown on the submitted site plans including trees along Jamestown Avenue and High Street. Tree species and size shall be subject to approval by the Planning Department.
