A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT <br />PURSUANT TO SECTION 40-55 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA, 1973, CONSISTING OF SIX APARTMENTS IN A <br />MIXED USE DEVELOPMENT AT 1927 HIGH STREET. <br /> <br /> WHEREAS, Quarter Century Corporation, by Kirk Berkley, <br />has made application pursuant to ~40-55 of the Code of the <br />City of Portsmouth, Virginia, 1973, as amended, for the <br />granting and approval of a group housing project consisting of <br />six (6) apartments to be developed in a mixed use development <br />at 1927 High Street, such premises further described as Tax <br />Map 169, Parcels 7, 8, 21 and 9.1, and such group housing <br />project having been designated as GHP-88-6 and consisting of <br />two (2) units on the first floor and four (4) units on the <br />second floor within the structure on the property; and <br /> <br /> WHEREAS, the application has been determined by the <br />Planning Commission to have met the requirements of ~40-55 of <br />the Code of the City of Portsmouth, Virginia, 1973, as <br />amended, and the Planning Commission has reviewed such <br />application and site plan submitted therewith and has <br />recommended a conditional approval of said application; and <br /> <br /> WHEREAS, the developer has been informed that approval of <br />a group housing project pursuant to ~40-55 grants only an <br />exemption from certain requirements for residences as stated <br />in said section, and does not constitute a waiver of any other <br />requirement embodied in the Subdivision Ordinance, Zoning <br />Ordinance, Code of the City of Portsmouth, or any other <br />applicable local, state or federal law or regulation; and <br /> <br /> WHEREAS, the developer is aware that building.permits or <br />any other required permit be issued only upon compliance with <br />the ordinances, laws, or regulations applicable thereto. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia, that the certain group housing <br />project described above and designated as GHP-88-6 and more <br />specifically described by correspondence from Kirk Berkley, <br />AIA, as shown on plans filed with the appropriate officials of <br />the City of Portsmouth, Virginia, such correspondence and <br />plans being made a part hereof, is hereby granted approval <br />subject to the following terms and conditions: <br /> <br /> (1) A certificate of compliance for the final plans must <br />be obtained from the DowntownIDesign Committee prior to <br />issuance of building permits. <br /> <br /> (2) Landscaping shall be installed as shown on the <br />submitted site plans including trees along Jamestown Avenue <br />and High Street. Tree species and size shall be subject to <br />approval by the Planning Department. <br /> <br /> <br />
