81 A RESOLUTION GRANTING A USE PERMIT TO JAMES WILCOX FOR THE OPERATION OF A FLEA MARKET AT 3709 VICTORY BOULEVARD. WHEREAS, James Wilcox has made application pursuant Section 40-71Ib) of the Code of the City of Portsmouth, Virginia, 1988, for the granting of a use permit as hereinafter-described; and to WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the denial of said use permit. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit hereinafter-described is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to the property or improvements of the neighborhood; and (c) Will be in accordance with the purposes of the Zoning Chapter of the City Code. 2. James Wilcox is hereby granted a use permit pursuant to Section 40-71(b) of the Code of the City of Portsmouth, Virginia, 1988, for the operation of a flea market on property located at 3709 Victory Boulevard and being more particularly described as Tax Map 529, Parcels 1, 1.1, and 2 (UP-89-18). 3. This use permit is approved subject to the following conditions: (a) Sale and display of merchandise shall not take place within thirty feet of any property line. (b) Adequate vegetative screening, as approved by the Planning Department, shall be provided along Cavalier Boulevard, Rapidan'Street, and the site's southern property line, so as to screen the flea market operations from public view, within forty-five days of the adoption of this resolution.
