53 <br /> <br />A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT <br />PURSUANT TO SECTION 40-55 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA, 1988, SAID PROJECT CONSISTING OF 132 <br />MULTI-FAMILY RESIDENTIAL UNITS ON THE NORTH SIDE OF GATEWAY <br />DRIVE AND DESIGNATED AS GHP-89-2. <br /> <br /> WHEREAS, J. Gregory Dodd, representing Westwinds <br />Associates and Newman Associates, has made application <br />pursuant to §40-55 of the Code of the City of Portsmouth, <br />Virginia, 1988, as amended, for the granting and approval of a <br />group housing pro3ect consisting of one hundred and thirty-two <br />(132) multi-family residential units on a 14.25 acre parcel on <br />the north side of Gateway Drive and such parcel being further <br />described as Parcel 8 of Zoning Amendment Ordinance Z-89-4, <br />such group housing project having been designated as GHP-89-2; <br />and <br /> <br /> WHEREAS, the application has been determined by the <br />Planning Commission to have met the requirements of §40-55 of <br />the Code of the City of Portsmouth, Virginia, 1988, as <br />amended, and the Planning Commission has reviewed such <br />application and site plan submitted therewith and has <br />recommended a conditional approval of said application; and <br /> <br /> WHEREAS, the developer has been informed that the <br />approval of'a group housing project pursuant to §40-55 grants <br />only an exemption [rom certain requirements for residences as <br />stated in said section and does not constitute a waiver of any <br />other requirement embodied in the Subdivision Ordinance, <br />Zoning Ordinance, Code of the City of Portsmouth, Virginia, or <br />any other applicable local, state, or federal law or <br />regulation; and <br /> <br /> WHEREAS, the developer is aware that building <br />any other required permit will be issued only upon <br />of the ordinances, laws and regulations applicable <br /> <br />permits or <br />compliance <br />thereto. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virglmla that the certain group housing project <br />consisting of one hundred thirty-two (132) multi-family <br />residential units designated as GHP-89-2 and more specifically <br />described on plans filed with the appropriate officials of the <br />City of Portsmouth, Virginia, such plans and documentations in <br />support thereof being made a part hereof is hereby granted <br />approval subject to the following terms and conditions: <br /> <br /> (1) The group housing project shall be limited to a <br />maximum of one hundred thirty-two (132) multi-family units. <br /> <br /> (2) Approval from the Corps of Engineers must be <br />obtained prior to the filling of any non-tidal wetlands. <br /> <br /> <br />
