A RESOLUTION GRANTING A USE PERMIT TO KINDER-CARE LEARNING <br />CENTERS, INC. TO OPERATE A CHILD-CARE CENTER ON CHURCHLAND <br />BOULEVARD. <br /> <br /> WHEREAS, Gary E. Adams, Regional Real Estate Manager for <br />Kinder-Care Learning Centers, Inc., has made application <br />pursuant to ~40-71 (b) of the Code of the City of Portsmouth, <br />Virginia, 1973, for the granting of a use permit to operate a <br />child-care center adjacent to the Academy Crossing Shopping <br />Center on Churchland Boulevard; and <br /> <br /> WHEREAS, the applicant and the Planning Director have <br />done all things required to be done in connection with said <br />apDlication; and <br /> <br /> WHEREAS, the Planning Commission has recommended the <br />conditional granting of a use permit for the operation of a <br />child-care center. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia: <br /> <br />1. That the use for which the use permit is sought: <br /> <br /> (a) Will not adversely affect the health and safety <br />of persons residing or working in the neighborhood of the <br />proposed use; <br /> <br />injurious <br />and <br /> <br />(b) Will not be detrimental to the public use or <br />to the property or improvements of the neighborhood; <br /> <br /> (c) Will be in accordance with the purposes of the <br />Zoning Chapter of the City Code. <br /> <br /> 2. Kinder-Care Learning Centers, Inc. is hereby granted <br />a use permit pursuant to ~40-71 (b) of the Code of the City of <br />Portsmouth, Virginia, 1973, to operate a child-care center <br />adjacent to the Academy Crossing Shopping Center on Churchland <br />Boulevard, such proDerty being more particularly described as <br />follows: <br /> <br />UP-88-16 <br /> <br /> BEGINNING at an old i~on pin in the <br />southern Fight-of-way line of Churchland <br />Boulevard at the common corner of the herein <br />described parcel and the t~act of land <br />presently owned by the Churchland Baotist <br />Church; thence leaving said beginning point <br />and running along said ~ight-of-way line S 69° <br />40' 43" E 63.82 feet to a concrete monument at <br /> <br /> <br />
