A RESOLUTION GRANTING A USE PERMIT TO KINDER-CARE LEARNING CENTERS, INC. TO OPERATE A CHILD-CARE CENTER ON CHURCHLAND BOULEVARD. WHEREAS, Gary E. Adams, Regional Real Estate Manager for Kinder-Care Learning Centers, Inc., has made application pursuant to ~40-71 (b) of the Code of the City of Portsmouth, Virginia, 1973, for the granting of a use permit to operate a child-care center adjacent to the Academy Crossing Shopping Center on Churchland Boulevard; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said apDlication; and WHEREAS, the Planning Commission has recommended the conditional granting of a use permit for the operation of a child-care center. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; injurious and (b) Will not be detrimental to the public use or to the property or improvements of the neighborhood; (c) Will be in accordance with the purposes of the Zoning Chapter of the City Code. 2. Kinder-Care Learning Centers, Inc. is hereby granted a use permit pursuant to ~40-71 (b) of the Code of the City of Portsmouth, Virginia, 1973, to operate a child-care center adjacent to the Academy Crossing Shopping Center on Churchland Boulevard, such proDerty being more particularly described as follows: UP-88-16 BEGINNING at an old i~on pin in the southern Fight-of-way line of Churchland Boulevard at the common corner of the herein described parcel and the t~act of land presently owned by the Churchland Baotist Church; thence leaving said beginning point and running along said ~ight-of-way line S 69° 40' 43" E 63.82 feet to a concrete monument at
