AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, 1988, BY AMENDING SECTION 40-31 THEREOF, AND BY <br />ADDING TO CHAPTER 40 THEREOF, SECTION 40-58 PERTAINING TO <br />PARKING OF CERTAIN VEHICLES AND EQUIPMENT IN RESIDENTIAL <br />DISTRICTS. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Section 40-31 of the Code of the City of <br />Portsmouth, Virginia, 1988, be amended by adding thereto, <br />following definitions to read as follows: <br /> <br />the <br /> <br />Section 40-31. Definition. <br /> <br /> COMMERCIAL VEHICLE: A truck, bus, or other <br />self-propelled vehicle of any type or a container constructed <br />for the transportation of materials used or maintained <br />primarily for business purposes to transport goods, equipment <br />or passenqers. This definition is not applicable to a vehicle <br />described as a pick-up truck, van or panel truck, that does <br />not exceed one (1) ton in manufacture's rated capacity. <br /> <br /> MOBILE CONSTRUCTION EQUIPMENT: Any vehicle or equipment <br />not designed or used primarily for the transportation of <br />persons or property and only incidentally operated or moved <br />over highways or streets, including, but not limited to, <br />ditch-digging apparatus, asphalt spreaders, cement mixers, <br />brush chippers, wheel backhoes, loaders, ditchers, finishing <br />machines, motor graders, road rollers, scarifiers, scrapers, <br />excavators, drag lines, cranes, and earth-moving equipment. <br /> <br /> 2. That Chapter 40 of the Code of the City of <br />Portsmouth, Virginia, 1988, be amended by adding thereto <br />Section 40-58 to read as follows: <br /> <br />Section 40-58. Parking and/or storage of certain vehicles and <br /> equipment prohibited in residential districts. <br /> <br /> The parking of a commercial vehicle and the parking or <br />storage of mobile ccnstruction equipment is prohibited in any <br />residential district, or subdistrict and in Office Residential <br />OR-75-District, except that one (1) commercial vehicle used by <br />a resident of the premises may be parked on any lot on which <br />there is located a main building provided that such vehicle is <br />parked in an enclosed garage, accessory building, carport or <br />on an improved driveway. This prohibition shall not be <br />interpreted to prohibit commercial vehicles from loading and <br />unloading in any residential district nor to prohibit mobile <br /> <br /> <br />
