AN ORDINANCE TO AMEND CHAPTER 4 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA, 1973, AS AMENDED, PERTAINING TO ANIMALS <br />AND FOWL. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br />1. That Section 4-2 be ordained to read as follows: <br /> <br />Section 4-2. Standards for keeping animals and household <br /> pets. <br /> <br /> Ail animals, including household pets, shall be kept or <br />maintained so as not to constitute a public nuisance by <br />concentration or number, causing production of insects, <br />excessive odor, dust, noise, or other conditions detrimental <br />to the community health and welfare. <br /> <br />2. That Section 4-12 be ordained to read as follows: <br /> <br />Section 4-12. Keeping of dogs and cats. <br /> <br /> It shall be unlawful for any person to maintain an <br />accessory structure for the housing of dogs or cats on land <br />zoned for residential use or mixed residential use in the City <br />that exceeds, in floor area, one-half (1/2) percent of the lot <br />area and neither the building nor any fence-enclosed roaming <br />area shall be closer than fifteen (15) feet to a property <br />line. This accessory structure and enclosed roaming area <br />shall be limited to rear yards. <br /> <br />3. That Section 4-13 be ordained to read as follows: <br /> <br />Section 4-13. Wild, dangerous or carnivorous animals, or <br /> dangerous or poisonous reptiles or serpents. <br /> <br /> It shall be unlawful for any person to keep within this <br />City an elephant, bear, leopard, lion, wolf, or any dangerous <br />or carnivorous wild animals, or dangerous or poisonous <br />reptiles or serpents. A wild animal is defined as one that is <br />incapable of being completely domesticated and requires the <br />exercise of art, force, or skill to keep it in subjection. <br /> <br /> 4. That this ordinance shall take effect from the date <br />its adoption. <br /> <br /> <br />
