AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, BY AMENDING SECTIONS 40-120, 40-121 (a), 40-12I (b), 40-122 (a), 40-123 (a) (b) (c) AND (d), AND BY ADDING THERETO SECTION 40-288.1, PERTAINING TO DOWNTOWN DISTRICT. BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: 1. That Sections 40-120, 40-121 (a), 40-121 (b), 40-122 (a), 40-123 (a) (b) (c) and (d) of the Code of the City of Portsmouth, 1973, be amended to read as follows: ARTICLE V.I. Downtown District Section 40-120. Downtown District Design Committee. (a) To further execute the purposes and objectives declared in §40-118 and pursuant to the power granted and conferred upon the City, there is hereby created and established a Downtown Design Committee which shall be referred to as "the Committee." (b) The Committee shall consist of seven (7) members, all of whom shall be residents of the City, to be appointed by City Council for a term of three (3) years from the date of such appointment. Of the members appointed, one (1) shall be appointed from at least three (3) nominees made by the Portsmouth Downtown Merchant's Association, one (1) shall be appointed from at least three (3) nominees made by the Portsmouth Chamber of Commerce, four (4) shall be chosen to provide professional expertise as architects, design professionals, real estate professionals or historians, and one (1) shall be appointed from the City-at-large. Members of the Committee shall serve without compensation. (c) The Committee shall implement the purposes and objectives of the "Priority Action Program For Central Portsmouth" hereinafter referred to as "the Plan" through the design guidelines and issuance of Certificate of Intent and Compliance. (d) The Committee shall meet as and when called upon by the chairman or by at least two (2) members of the Committee. (e) The Committee shall appoint a chairman and vice chairman from among its members and a secretary who shall an employee of the City Planning Commission. be (f) The Committee may employ a consultant and seek advice from any City department as it deems it necessary.
