to Section 46.2-395 of the Code of Virginia, the court shall <br />not suspend the entire jail sentence in any case but may, in <br />its discretion, suspend a portion thereof. However, this <br />provision, in the discretion of th~ court, shall not apply if <br />the operation of the motor vehicle was due to an emergency <br />involving danger to the health or life of any person or to <br />property; and the court may, in its discretion, prescribe that <br />the jail sentence shall be served at such time or times as the <br />court may direct after considering the circumstances of the <br />person convicted of violating this section. <br /> <br />Section 22-349. <br /> <br />Driving while restoration of license <br />is contingent upon furnishing proof <br />of financial responsibility. <br /> <br /> (a) No person, resident or nonresident, whose driver's <br />license or instruction permit has been suspended or revoked by <br />any court or by the commissioner of the state department of <br />motor vehicles, or by operation of law pursuant to the <br />provisions of this chapter, Title 46.2 of the Code of <br />Virginia, Section 18.2-271 of the Code of Virginia or any <br />similar law or regulation or who has been forbidden as <br />prescribed by law by the commissioner of the state department <br />of motor vehicles, the state corporation commission, the state <br />highway and transportation commissioner of the superintendent <br />of state police to operate a motor vehicle in this state shall <br />drive any motor vehicle in this city during any period wherein <br />the restoration of the license or privilege is contingent upon <br />the furnishing of proof of financial responsibility in the <br />manner provide in article 16 of chapter 3 of Title 46.2 <br />(~46.2-467 et seq.) of the Code of Virginia. <br /> <br />Section 22-395. <br /> <br />Same- Penalty for reckless driving <br />under Section 22-391, 22-392 or <br />22-393. <br /> <br /> (b) In addition to the penalties for reckless driving <br />prescribed in subsection (a) of this section, if any person is <br />convicted of reckless driving under any section referred to <br />therein, the court may suspend any license issued to such <br />convicted person under chapter 3 of Title 46.2 (~46.2-300, <br />et seq.) of the Code of Virginia for a period of not less than <br />ten (10) days nor more than six (6) months and such court <br />shall require the convicted person to surrender his license so <br />suspended to the court where it will be disposed of in <br />accordance with Section 22-347 of this chapter. If the person <br />so convicted has not obtained the license required by such <br />chapter, or is a nonresident, the court may direct in the <br />judgement of conviction that such person shall not, for a <br />period of not less than ten (10) days or more than six (6) <br />months as may be prescribed in the judgement, drive or operate. <br />any motor vehicle in the commonwealth.
