In the event any payment is not made on the due <br /> date, interest on the amount due shall accrue from such <br /> date at the ~urrent Prime Rate as determined by Chase <br /> <br /> Manhattan Bank, N.A., until paid. <br /> 10.02 Damages and Defense, <br /> <br /> A. Grantee shall indemnify and hold the City <br /> harmless for any damage or loss to any real or personal <br /> property of the City or any person, and for injury to or <br /> death of any person and any officer, employee or agent of <br /> the City, arising out of or in connection with the <br /> construction, operation, maintenance, repair, or removal <br /> of, or any other action of Grantee with respect to, the <br /> System, any service or related activity, or the <br /> distribution of any service over the System. Grantee <br /> shall, at its own cost and expense, reasonably replace, <br /> repair, or restore all such property to its prior <br /> condition. <br /> <br /> B.
