Grantee, Grantee shall, if requested by the subscriber, <br /> credit one-thirtieth (1/30th) of the monthly charge to the <br /> Subscriber for each twenty-four (24) hours during which a <br /> Subscriber is without service. <br /> <br /> 9.08 Interruption of Service. <br /> <br /> A. Absent conditions beyond the reasonable control <br /> of Grantee, Grantee shall at all times use its best efforts <br /> to maintain all parts of the System in good condition and <br /> repair through the term of this Franchise so as to provide <br /> service to all Subscribers on an uninterrupted basis. <br /> <br /> B. Grantee shall promptly notify the City of any <br />significant Outage in the operation of the System. For the <br />purpose of this Section 9.08, a "significant Outage in the <br />operation of the System" shall mean any Outage of a <br />duration of at least four (4) hours to at least fifteen <br />percent (15%) of the Subscribers. Grantee shall keep an <br />Outage log in which all Outages shall be regularly logged <br />and will be maintained on a rolling six (6) month basis. <br />The City shall have access to such log upon reasonable <br />notice and at reasonable times. <br /> <br /> C. Grantee shall exercise its best efforts to limit <br />any interruption of service for the purpose of maintaining, <br />repairing, or upgrading the System to periods of minimum <br />use. <br /> <br /> D. For purposes of computing the duration of an <br />Outage, said period shall begin when Grantee has actual <br /> <br />-27- <br /> <br /> <br />
