AN ORDINANCE CLOSING A PORTION OF PERRY STREET. WHEREAS, the City of Portsmouth has made application vacate, close and discontinue the hereinafter described portion of Perry Street; and to WHEREAS, by resolution of this Council adopted October 11, 1988, viewers were appointed pursuant to Section 15.1-364, Code of Virginia, 1950, as amended, to view the hereinafter described portion of said street and to report in writing whether in their opinion any, and if any what, inconvenience would result from discontinuing said portion of Perry Street~ and WHEREAS, the said viewers have reported in writing that in their opinion no inconvenience would result from closing and discontinuing of said street. NOW, THEREFORE, BE of Portsmouth, Virginia, portion of Perry Street street. IT ORDAINED Dy the Council of the City that the hereinafter described be closed and vacated as a public Ail that certain portion of Perry Street, shown on the map of Cradock, recorded in the Clerk's Office of the Circuit Court of the City of Chesapeake, in Map Book 70, pages 93-100, being bounded on the west by Victory Boulevard and on the east by Paradise Creek. BE IT FURTHER ORDAINED that that the City of Portsmouth hereby reserves unto itself a perpetual easement, right and privilege to install, operate, maintain and replace sewer mains, sewer drains, sanitary sewers and electric power lines over, under and across the hereinafter described pcrtion of Perry Street. BE IT FURTHER ORDAINED, that this street closure shall be subject to the following conditions: 1. The public shall have the right of ingress and egress along the hereinabove-described street during the hours of operation of the adjacent marina. 2. The right of public ingress and egress shall include, but not be limited to, the right of temporary tying of boats at the end of the hereinabove-described property for the purpose of loading and unloading of pleasure boats.
