AN ORDINANCE CLOSING A PORTION OF PERRY STREET. <br /> <br /> WHEREAS, the City of Portsmouth has made application <br />vacate, close and discontinue the hereinafter described <br />portion of Perry Street; and <br /> <br />to <br /> <br /> WHEREAS, by resolution of this Council adopted October <br />11, 1988, viewers were appointed pursuant to Section 15.1-364, <br />Code of Virginia, 1950, as amended, to view the hereinafter <br />described portion of said street and to report in writing <br />whether in their opinion any, and if any what, inconvenience <br />would result from discontinuing said portion of Perry Street~ <br />and <br /> <br /> WHEREAS, the said viewers have reported in writing that <br />in their opinion no inconvenience would result from closing <br />and discontinuing of said street. <br /> <br /> NOW, THEREFORE, BE <br />of Portsmouth, Virginia, <br />portion of Perry Street <br />street. <br /> <br />IT ORDAINED Dy the Council of the City <br />that the hereinafter described <br />be closed and vacated as a public <br /> <br /> Ail that certain portion of Perry Street, <br />shown on the map of Cradock, recorded in the <br />Clerk's Office of the Circuit Court of the City <br />of Chesapeake, in Map Book 70, pages 93-100, <br />being bounded on the west by Victory Boulevard <br />and on the east by Paradise Creek. <br /> <br /> BE IT FURTHER ORDAINED that that the City of Portsmouth <br />hereby reserves unto itself a perpetual easement, right and <br />privilege to install, operate, maintain and replace sewer <br />mains, sewer drains, sanitary sewers and electric power lines <br />over, under and across the hereinafter described pcrtion of <br />Perry Street. <br /> <br /> BE IT FURTHER ORDAINED, that this street closure shall be <br />subject to the following conditions: <br /> <br /> 1. The public shall have the right of ingress and egress <br />along the hereinabove-described street during the hours of <br />operation of the adjacent marina. <br /> <br /> 2. The right of public ingress and egress shall include, <br />but not be limited to, the right of temporary tying of boats <br />at the end of the hereinabove-described property for the <br />purpose of loading and unloading of pleasure boats. <br /> <br /> <br />
