AN ORDINANCE TO AMEND CHAPTER 4 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988), AS ~4ENDED, BY AMENDING SECTION <br />4-32 THEREOF PERTAINING TO IMPOUNDMENT OF STRAY DOGS. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1o That Section 4-32 of the Code of the City of <br />Portsmouth, Virginia, 1988, be amended to read as follows: <br /> <br />Section 4-32. Impoundment when running at large without <br /> leash or muzzle. <br /> <br /> (a) It shall be the duty of the animal warden to catch <br />and turn over to the Portsmouth Humane Society, Inc., for <br />impounding any dog found off the owner's premises, unless the <br />dog is accompanied by an attendant and held in leash by a <br />responsible person or is securely muzzled, as provided in <br />Section 4~31. <br /> <br /> (b) If a dog is impounded pursuant to subsection[a) of <br />this section, it shall be the duty of the animal warden and <br />the Portsmouth Humane Society, Inc. to make a reasonable <br />effort to ascertain if the dog has a tag, license, or tattooed <br />identification. If such identification is found on the dog, a <br />reasonable effort shall be made to return the dog to its owner <br />or to place the dog for adoption before humanely destroying <br />it. <br /> <br /> (c) Every dog impounded pursuant to subsection (a) of <br />this section shall be penne~ for five (5) days, except that <br />any impounded dog whose owner is identified shall be held for <br />an additional five days. Such period shall commence on the <br />day immediately following the day the dog is initially <br />confined in the Portsmouth Humane Society facility. During <br />the period of impoundment, the dog may be redeemed by the <br />owner by paying to the attendant at the dog pound the sum of <br />three dollars ($3.00) for the first day and one dollar ($1.00) <br />for each additional day or any part thereof to cover the cost <br />of maintaining s pen for such dog and of the care and keep of <br />such dog and by exhibiting to the person in charge of the dog <br />pound the receipt for the license tax required to be paid by <br />this chapter. All such impounding fees shall be paid over to <br />the City Treasurer monthly. <br /> <br /> (d) If not redeemed within the time periods provided for <br />in subsection(c) of this section, a dog impounded pursuant to <br />this section shall be disposed of, other than by sale, by the <br />Portsmouth Humane Society, Inc. <br /> <br /> <br />
