AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1988, AS AMENDED, BY AMENDING SECTION 32-5 (a) AND (b), AND BY ADDING THERETO PARAGRAPH (c), PERTAINING TO VACATION OF STREETS, ETC. BE ~T ORDAINED by the Council of Ehe City of Portsmouth, Virginia: 1. That Chapter 32 of the Code of the City of Portsmouth, Virginia, 1988, as amended, be amended to read follows: as Section 32-5. Application for vacation of street, alley, easement, right-of-way, or other public way; appointment of viewers. (a) A fee of one hundred dollars ($100.00) shall be paid to the city for processing of an application for the vacation of any street, alley, easement, right-of-way or other public way; pursuant to Section 15.1-364 of the Code of Virginia. All closure proceedings shall be commenced by filing an application for closure with the city planner. All applications shall be submitted on forms prescribed by the city planner. The city planner shall not receive any application unless the fee is paid at the time the application is filed. (b) On applications the~City Council ~ay appoint not less than three (3) nor more than five (5) viewers to view any street, alley, easement, right-of-way or other public way; and report in writing whether, in their opinion, any, and if any, what inconvenience would result from discontinuing the same. Such viewers shall be paid a fee of twenty-five dollars ($25.00) each for their services and same shall be paid by the person making the application to alter or vacate the street or alley. (c) As a condition to vacation of any street, alley, easement, right-of-way or other public way, the person making the application for closure may, at Council's option, be required to purchase from the City the street, alley, easement or other public way for which the vacation is requested. The City and its affiliated political subdivisions such as the Industrial Development Authority and Portsmouth Redevelopment and Housing Authority shall be exempt from paying the purchase price, in those cases where the affiliated political subdivision becomes the owner of the land in question, and is not just acting on behalf of the adjoining property owners.
