AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, 1988, AS AMENDED, BY AMENDING SECTION 32-5 (a) AND <br />(b), AND BY ADDING THERETO PARAGRAPH (c), PERTAINING TO <br />VACATION OF STREETS, ETC. <br /> <br /> BE ~T ORDAINED by the Council of Ehe City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Chapter 32 of the Code of the City of <br />Portsmouth, Virginia, 1988, as amended, be amended to read <br />follows: <br /> <br />as <br /> <br />Section 32-5. <br /> <br />Application for vacation of street, alley, <br />easement, right-of-way, or other public way; <br />appointment of viewers. <br /> <br /> (a) A fee of one hundred dollars ($100.00) shall be paid <br />to the city for processing of an application for the vacation <br />of any street, alley, easement, right-of-way or other public <br />way; pursuant to Section 15.1-364 of the Code of Virginia. <br />All closure proceedings shall be commenced by filing an <br />application for closure with the city planner. All <br />applications shall be submitted on forms prescribed by the <br />city planner. The city planner shall not receive any <br />application unless the fee is paid at the time the application <br />is filed. <br /> <br /> (b) On applications the~City Council ~ay appoint not <br />less than three (3) nor more than five (5) viewers to view any <br />street, alley, easement, right-of-way or other public way; and <br />report in writing whether, in their opinion, any, and if any, <br />what inconvenience would result from discontinuing the same. <br />Such viewers shall be paid a fee of twenty-five dollars <br />($25.00) each for their services and same shall be paid by the <br />person making the application to alter or vacate the street or <br />alley. <br /> <br /> (c) As a condition to vacation of any street, alley, <br />easement, right-of-way or other public way, the person making <br />the application for closure may, at Council's option, be <br />required to purchase from the City the street, alley, easement <br />or other public way for which the vacation is requested. The <br />City and its affiliated political subdivisions such as the <br />Industrial Development Authority and Portsmouth Redevelopment <br />and Housing Authority shall be exempt from paying the purchase <br />price, in those cases where the affiliated political <br />subdivision becomes the owner of the land in question, and is <br />not just acting on behalf of the adjoining property owners. <br /> <br /> <br />
