AN ORDINANCE CLOSING A PORTION OF MANCHESTER ROAD. WHEREAS, Gerchan Armistead has made application to vacate, close and discontinue the hereinafter described portion of Manchester Road; and WHEREAS, by resolution of this Council adopted April 10, 1990, viewers were appointed pursuant to Section 15.1-364, Code of Virginia, 1950, as amended, to view the hereinafter described portion of said street and to report in writing whether in their opinion any, and if any what, inconvenience would result from discontinuing said portion of Manchester Road and; WHEREAS, the said viewers have reported in writing that in their opinion no inconvenience would result from closing and discontinuing of said street. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Portsmouth, Virginia, that the hereinafter described portion of Manchester Road be closed and vacated as a public street. Beginning on the south right-of-way line of Manchester Road at a point 360' more or less from its intersection with the east right-of-way of Faigle Road; thence east along said right-of-way 180' to a point; thence north 40' to the north right-of-way of Manchester Road; thence west along said right-of-way 175' more or les;$ to a ~oint; thence south 40 feet to the south right- of way of Manchester Road, to the true point of beginning. ~ BE IT FURTHER ORDAINED that the City of Portsmouth hereby reserves un~o itself a perpetual easement, right and privilege to install, operate, maintain and replace sewer mains, sewer drains, sanitary sewers over, under and across the hereinafter described portion of Manchester Road; AND BE IT FURTHER ORDAINED that the public shall have the right of pedestrian ingress and egress to the riverfront across the easement which shall remain unobstructed and not built upon, but said right of ingress and egress shall not include the right to fish, crab or swim on or adjacent to said property.
