AN ORDINANCE CLOSING A PORTION OF MANCHESTER ROAD. <br /> <br /> WHEREAS, Gerchan Armistead has made application to <br />vacate, close and discontinue the hereinafter described <br />portion of Manchester Road; and <br /> <br /> WHEREAS, by resolution of this Council adopted April 10, <br />1990, viewers were appointed pursuant to Section 15.1-364, <br />Code of Virginia, 1950, as amended, to view the hereinafter <br />described portion of said street and to report in writing <br />whether in their opinion any, and if any what, inconvenience <br />would result from discontinuing said portion of Manchester <br />Road and; <br /> <br /> WHEREAS, the said viewers have reported in writing that <br />in their opinion no inconvenience would result from closing <br />and discontinuing of said street. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED by the Council of the City <br />of Portsmouth, Virginia, that the hereinafter described <br />portion of Manchester Road be closed and vacated as a public <br />street. <br /> <br /> Beginning on the south right-of-way line <br />of Manchester Road at a point 360' more or <br />less from its intersection with the east <br />right-of-way of Faigle Road; thence east along <br />said right-of-way 180' to a point; thence <br />north 40' to the north right-of-way of <br />Manchester Road; thence west along said <br />right-of-way 175' more or les;$ to a ~oint; <br />thence south 40 feet to the south right- <br />of way of Manchester Road, to the true <br />point of beginning. ~ <br /> <br /> BE IT FURTHER ORDAINED that the City of Portsmouth hereby <br />reserves un~o itself a perpetual easement, right and privilege <br />to install, operate, maintain and replace sewer mains, sewer <br />drains, sanitary sewers over, under and across the hereinafter <br />described portion of Manchester Road; <br /> <br /> AND BE IT FURTHER ORDAINED that the public shall have the <br />right of pedestrian ingress and egress to the riverfront <br />across the easement which shall remain unobstructed and not <br />built upon, but said right of ingress and egress shall not <br />include the right to fish, crab or swim on or adjacent to <br />said property. <br /> <br /> <br />
