<br /> BE IT ORDAINED by the Council of the City of Portsmouth,
<br />Virginia:
<br />
<br /> 1. That Section 24-49(a) of the Code of the City of
<br />Portsmouth, Virginia, 1988, be amended to read as follows:
<br />
<br />Section 24-49. Certain premises deemed common nuisance.
<br />
<br /> (a) Any office, store, shop, restaurant, dance hall,
<br />theater, poolroom, clubhouse, storehouse, warehouse, dwelling
<br />house, apartment, building of any kind, vehicle, vessel, boat
<br />or aircraft, which with the knowledge of the owner, lessor,
<br />agent of any such lessor, manager, chief executive officer or
<br />operator thereof, is frequented by persons under the influence
<br />of illegally obtained controlled substances or marijuana or
<br />for the purpose of illegally obtaining possession of,
<br />manufacturing or distributing controlled substances or
<br />marijuana, or which is used fo~ the illegal possession,
<br />manufacture or distribution of ~ontrolled substances or
<br />mari3uana, shall be deemed a common nuisance.
<br />
<br /> 2. That Sections 24-1, 24-2, 24-7, 24-37 through 24-42,
<br />24-44, 24-69, 24-72, 24-74, 24-77, 24-78, 24-134 through
<br />24-136, 24-171, 24-174 through 24-176, 24-196 through 24-204,
<br />24-206, 24-209, 24-210, 24-226 through 24-228, 24-249, 24-251,

<br /> 3. That this ordinance shall take effect on the date of
<br />its adoption.
