AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, 1988, AS AMENDED, BY AMENDING SECTION 20-7 TO <br />CHAPTER 20, PERTAINING TO LICENSES. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Section 20-7 (a) and (b) of Chapter 20 of the <br />Code of the City of Portsmouth, Virginia, 1988, be amended to <br />read as follows: <br /> <br />Section 20-7. Penalty for doing business without a license. <br /> <br /> (a) It shall be unlawful for any person to commence to <br />conduct any business or engage in aQy occupation or <br />profession, or do any other thing for which a license tax is <br />required under this Chapter without first obtaining a license <br />or tag or sign required under this Chapter, without first <br />obtaining a license or tag or sign required under this <br />Chapter, or after having obtained the necessary license or tag <br />or sign required under this Chapter, to continue to do so for <br />a longer period than one (1) month after the expiration <br />thereof. <br /> <br /> (b) A violation of this section shall constitute a Class <br />1 Misdemeanor and each day of default or violation shall <br />constitute a separate offense. A conviction of such offense <br />shall not relieve any person from the payment of any license <br />tax imposed by this Chapter. <br /> <br /> (c) That in addition to the penalties provided for in <br />this section, or in addition to the penalties provided for in <br />this Chapter, the Commissioner of Revenue may, upon learning <br />of such continuing violation, seek to enjoin the continuing <br />violation in any cour~ of this City having jurisdiction to <br />grant such injunctive relief. <br /> <br /> (d) For purposes of this section, the word "person" <br />means associations, firms, partnerships, bodies politic and <br />incorporate as well as individuals. "Person" shall also mean: <br /> <br /> (1) Where the business is a corporation, the <br />president or managing agent of such corporation; <br /> <br /> (2) Where the business is an unincorporated <br />Dartnership or association, the general partner, partners, <br />managing agent of such unincorporated partnership or <br />association; and <br /> <br /> (3) Where the business is a sole proprietorship, <br />the owner or managing agent of such sole proprietorship. <br /> <br />or <br /> <br /> <br />
