AN ORDINANCE TO AMEND CHAPTER 22 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA, 1988, BY ADDING SECTION 22-11.1, <br />PERTAINING TO THE oPERATION OF TOW TRUCKS UNDER CERTAIN <br />CIRCUMSTANCES. <br /> <br /> BE IT ORDAINED by the <br />Virginia: <br /> <br /> 1. That the Code of <br />1988, be amended by adding <br />follows: <br /> <br />Council of the City of Portsmouth, <br /> <br />the City of Portsmouth, Virginia, <br />thereto Section 22-11.1 to read as <br /> <br />Section 22-11.1. Operation of tow trucks under certain <br /> circumstances. . <br /> <br /> The driver of any tow truck operated at or en route to or <br />from the scene of a traffic accident or similar emergency when <br />specifically directed by a law enforcement officer present at <br />the scene of a motor vehicle crash or similar incident may: <br /> <br /> (a) Operate on a highway in a direction opposite that <br />otherwise permitted for traffic; <br /> <br />(b) Cross medians of divided highways; <br /> <br /> (c) Use cross-overs and turn-arounds otherwise reserved <br />for use only by authorized vehicles; <br /> <br />(d) Drive on a portion of the highway other than the <br />roadway; <br /> <br />(e) Stop or stand on any portion of the highway; and <br /> <br /> (f) Operate in any cther manner as directed by a <br />law-enforcement officer at the scene. <br /> <br /> Nothing in this section, however, shall protect the <br />driver of any tow truck from criminal prosecution for conduct <br />constituting reckless disregard of the safety of persons and <br />property. Nothing in this section shall be construed to <br />release the driver of any tow truck from any civil liability <br />for failure to use reasonable care in operations permitted in <br />this section. <br /> <br />2. This ordin~nc~ shall take effect on July 1, 1990. <br /> <br /> <br />
