AN ORDINANCE TO AMEND CHAPTER 35 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA, 1988, AS AMENDED, BY AMENDING SECTION <br />35-160 (b), PERTAINING TO TAXATION. <br /> <br /> BE IT ORDAINED by <br />Virginia: <br /> <br />the Council of the City of Portsmouth, <br /> <br />35-160 (b) of Chapter 35 of the Code of <br />Virginia, 1988, be amended to read as <br /> <br /> 1. That Section <br /> the City of Portsmouth, <br /> follows: <br /> <br /> Section 35-160. Applicant's affidavit and certificate of <br /> disability Generally. <br /> <br /> (b) If the applicant is under sixty-five (65) years of <br />age, the affidavit required by this section shall have <br />~attached thereto a certification by the Department of <br /> Veteran's Affairs or the Railroad Retirement Board o~f such <br /> person is not eligible for certification by any of these <br /> agencies, a sworn affidavit by two (2) medical doctors who are <br /> either licensed to practice medicine in the Commonwealth or <br /> are military officers on active duty who practice medicine <br /> with the United States Armed Forces to the effect that such <br /> person is permanently and totally disabled, as defined in <br /> Section 35-156. The affidavit of at least one (1) of the <br /> doctors shall be base~ upon a physical examination of the <br /> person by such doctor. The affidavit of one (1) of the <br /> doctors may be based upon medical information contained in the <br /> records of the civil service commission which is relevant to <br /> the standards for determining such permanent and total <br /> disability. <br /> <br /> 2. This ordinance shall take effect on July 1, 1990. <br /> Adopted by the Council of the City of Portsmouth, <br /> Virginia, at a meeting held June 26, 1990. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
