AN ORDINANCE TO AMEND CHAPTER 24 OF THE CODE OF THE CITY OF
<br />PORTSMOUTH, VIRGINIA, 1988, BY AMENDING SECTIONS
<br />24-TIb)(3)a, 24-49, 24-72, 24-74(a), 24-74(d), 24-78, 24-83,
<br />24-253, 24-259, 24-325, AND 24-326 THEREOF, PERTAINING TO
<br />MISCELLANEOUS OFFENSES.

<br /> BE IT ORDAINED by the Council of the City of Portsmouth,
<br />Virginia:
<br />
<br /> 1. That Sections 24-7(b)(3)a, 24-49, 24-72, 24-74(a),
<br />24-78, 24-83, 24-253, 24-259, 24-325 and 24-326 of the Code of
<br />the City of Portsmouth, Virginia, 1988, be amended to read as
<br />follows:
<br />
<br />Section 24-7.
<br />
<br /> (b)(3)
<br />
<br /> a.
<br />
<br />Causing or encouraging acts rendering
<br />children delinquent, abused, etc.
<br />
<br />Delinquent child means:
<br />
<br />A child who has committed a delinquent act,
<br />that is, an act designated a crime under the
<br />laws of the Commonwealth or an ordinance of
<br />any city, county, town or service district,
<br />or under federal law, or a violation of a
<br />court order as provided for in section
<br />16.1-292 of the Code of Virginia, except an
<br />act which is otherwise lawful, but is
<br />designated a crime only if committed by a
<br />child; or for purposes'of section 16.1-241
<br />and subsection E.1 of 16.1-279 of the Code
<br />of Virginia, shall include a refusal to take
<br />a blood or breath test in violation of
<br />section 18.2-268 of the Code of Virginia or
<br />section 22-423; or
<br />
<br />Section 24-49. Certain premises deemed common nuisance.
<br />
<br /> (a) Any office, store, shop, restaurant, dance hall,
<br />theater, poolroom, clubhouse, storehouse, warehouse, dwelling
<br />house, apartment, building of any kind, vehicle, vessel, boat
<br />or aircraft, which with the knowledge of the owner, lessor,
<br />agent of any such lessor, manager, chief executive officer or
<br />operator thereof, is frequented by persons under the influence
<br />of illegally obtained controlled substances or marijuana or
<br />for the purpose of illegally obtaining possession of,
<br />manufacturing or distrieuting controlled substances or
<br />marijuana, or which is used for the illegal possession,
<br />manufacture or distribution of controlled substances or
<br />
