sides, the sides must be embedded into the ground no less than <br />one foot. <br /> <br /> (b) In any prosecution un~'er this section, an actual <br />attack by such animal upon any person conducting himself in a <br />lawful manner at the time of such attack, whether such attack <br />occurs on or off the property of the owner or custodian of <br />such animal, shall be deemed prima facie evidence that no such <br />adequate provisions were made. <br /> <br /> (c) In the event that an animal warden has probable <br />cause to believe that a vicious or destructive animal is being <br />harbored or cared for in violation of subsection (a), the <br />animal warden may seize and impound the animal pending trial. <br /> <br /> (d) Pending disposition by the court of the charge of <br />violating subsection (a), an owner or custodian may redeem his <br />animal upon payment of accrued fees and upon a showing to the <br />satisfaction of the animal warden that adequate provisions for <br />compliance with subsection (a) have been implemented. An <br />animal warden may again impound the animal pending disposition <br />of the original charge upon his determination that the owner <br />or custodian has again failed to confine the animal as <br />required under subsection (a). <br /> <br /> (e) Any animal not redeemed within five days of <br />disposition of the original charge by the court, shall be <br />disposed of, other than by sale, by the Portsmouth Humane <br />Society, Inc. <br /> <br /> (f) The provisions of this section permitting the <br />keeping of such animal within the city shall not apply to <br />those wil~ animals, or dangerous or poisonous reptiles or <br />serpents whose keeping within the city is prohibited under <br />Section 4-15. <br /> <br /> (g) Any person violating any of the provisions of the <br />section shall be deemed guilty of a Class 2 misdemeanor. <br /> <br /> 3.
