AN ORDINANCE TO AMEND CHAPTER 4 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA, 1988, BY AMENDING SECTIONS 4-9, 4-31 <br />(a), 4-32 (a), AND 4-33 THEREOF AND BY ADDING SECTIONS 4-16 <br />AND 4-17 THERETO PERTAINING TO VICIOUS AND DESTRUCTIVE <br />ANIMALS. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Sections <br />the Code of the City of <br />to read as follows: <br /> <br />4-9, 4-31 (a), 4-32 (a), and 4-33 of <br />Portsmouth, Virginia, 1988, be amended <br /> <br />Section 4-9. <br /> <br />Vicious or destructive animals; running at <br />large. <br /> <br /> (a) It shall be unlawful for any person to allow any <br />animal belonging to him or under his control, and known by him <br />to be dangerous, mischievous, vicious or destructive, to run <br />at large in the city. <br /> <br /> (b) Any person violating any of the provisions of the <br />section shall be deemed guilty of a Class 2 misdemeanor. <br /> <br />Section 4-31. <br /> <br />General prohibition against running at <br />large. <br /> <br /> (a) Except as provided in Section 4-33, it shall be <br />unlawful for any person who owns, keeps or harbors a dog or <br />has it in his care, or who acts as its custodian, or who <br />permits a dog to remain on or about a premises occupied by <br />him, to allow such dog to run at large unless such dog is <br />accompanied by an attendant and held leashed by a responsible <br />person or securely muzzled with a muzzle, the character of <br />which has been approved by the animal warden. <br /> <br />Section 4-32. <br /> <br />Impoundment when running at large without <br />leash or muzzle. <br /> <br /> (a) Required. It shall be the duty of the animal warden <br />to catch and turn over to the Portsmouth Humane Society, Inc., <br />for impounding any dog found off the owner's premises, in <br />violation of Section 4-31. <br /> <br /> <br />
