<br />A RESOLUTION AUTHORIZING THE CITY MANAGER TO CONVEY,
<br />QUIT-CLAIM AND RELEASE ALL INTEREST OF THE CITY OF PORTSMOUTH
<br />TO EASEMENTS SET FORTH BY DEED OR PLAT WITHIN THE AREA
<br />ENCOMPASSED BY THE NORT~ TRUXTUN SEWER IMPROVEMENTS PROJECT.
<br />
<br /> WHEREAS, it is necessary that sanitary sewer lines
<br />area encompassed by the North Truxtun Sewer Improvements
<br />Project be replaced and abandoned because of age and
<br />difficulty of repair; and
<br />
<br />in the
<br />
<br /> WHEREAS, the City of Portsmouth operates and maintains
<br />said lines within the easements provided for utilities as set
<br />forth on the plats, and by deeds of easement granted to the
<br />City of Portsmouth; and
<br />
<br /> WHEREAS, the construction of new sanitary sewers will be
<br />in the streets encompassed by the North Truxtun Sewer
<br />Improvements Project, and the City of Portsmouth will have no
<br />further need for easements as set forth by deed or plat within
<br />the area of said project except as described herein.

<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City
<br />of Portsmouth, Virginia, that the City Manager be, and he
<br />hereby is, authorized to convey, quit-claim and release the
<br />hereinafter-described interest of the City of Portsmouth to
<br />the owners of property encompassed in the North Truxtun Sewer
<br />Improvements Project, to-wit:

<br /> Ail right, title and interest that the City
<br />of Portsmouth has in those areas designated as
<br />easements as shown on the plat of North Truxtun,
<br />made by S. W. Armistead, C.E., dated February,
<br />1947, duly recorded in the Clerk's Office of the
<br />Circuit Court of the City of Portsmouth,
<br />Virginia in Map Book 2 at pages 37, 38, 39 and
<br />40; and as set forth in Deed Book 172 at page
<br />118 in the aforementioned Clerk's Office; SAVE
<br />AND EXCEPT its right to construct, operate and
<br />maintain a sanitary sewer within the confines of
<br />the easements set forth herein upon Lots 304,
<br />305, 152 and 153; and its right to construct,
<br />operate and maintain drainage facilities within
<br />the confines of the easements as set forth
<br />herein on Lots 52, 53, 34, 33, 90, 91, 63, 64,
<br />70, 71, 76, 77, 98 through 102, 103 through 108,
<br />135, 250, 83, 84, 298, 300, 4, 5, 25, and 26.
