47 A RESOLUTION GRANTING A USE PERMIT TO WAYNE E. ELLSWORTH FOR THE CONVERSION OF AN EXISTING SINGLE-FAMILY DWELLING TO A DUPLEX RESIDENCE AT 634 FLORIDA AVENUE. WHEREAS, Wayne E. Ellsworth has made application pursuant to section 40-102(B) of the Code of the City of Portsmouth, Virginia for a use permit to convert an existing single-family residence to a duplex residence at 634 Florida Avenue (Tax Map 170, Parcel 28) which is located in the Port Norfolk Historic District; and WHEREAS, the applicant and the done all things required to be done application; and Planning Director have in connection with said WHEREAS, ~he Planning Commission has recommendedthe granting of a use permit, with conditions, for the conversion of an existing single-family dwelling to a duplex residential structure. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit is sought: (a) Will not adversely affect the health and safety' of persons residing in the neighborhood of the proposed use; (b) Will not be detrimental to injurious to the property or improvements and the public use or in the neighborhood; (c) Will be in accord with the purposes of the Zoning Chapter of the City Code. 2. Wayne E. Ellsworth is hereby granted a use permit pursuan~ to section 40-102(B) to convert an existing single-family residence to a duplex residential structure at 634 Florida Avenue, such conversion to be in compliance with the regulations applicable to the Port Norfolk Historic Residential District as provided for in the Zoning Chapter-of the qode of the City of Portsmouth, Virginia, 1973, as amended, such approval being granted subject to the following terms and conditions: (a) The applicant shall comply with all applicable codes, ordinances, policies and regulations of the City of Portsmouth, Virginia, and shall obtain all necessary licenses and permits.
