designee. <br /> <br /> (f) If violations of the conditions of this use permit <br />occur, the City Manager of the City of Portsmouth or his <br />designee shall be empowered to require that operation of the <br />facility, or any part thereof, be discontinued until proper <br />corrective action has been taken. <br /> <br /> (g) Facility shall be constructed and operated in <br />accordance with document entitled "CGX Environmental Systems <br />of Portsmouth, Inc., Project Summary", submitted by the <br />applicant, unless otherwise modified by conditions contained <br />herein or by an alternate acceptable to the Council of the <br />City of Portsmouth. <br /> <br /> (h) No deliveries of solid wasze will be permitted <br />between the hours of 6:30 and 7:30 a.m. and between the hours <br />of 3:45 and 4:45 p.m. The City Manager, upon recommendation <br />by the City Traffic Engineer, may modify the terms of this <br />condition, provided that: <br /> <br />(1) <br /> <br />The City Manager or his designee will provide <br />the operator 30 days advance notice of the <br />effective date of modification; and <br /> <br />(2) <br /> <br />The prohibitions against deliveries shall not <br />extend beyond the hours between 6:00 and 9:00 <br />a.m. and between 3:30 and 6:30 p.m. <br /> <br />(i) <br /> <br />The cost of any improvements or modifications to <br />public waterlines, sanitary sewerage or sewage <br />treatment facilities directly generated by this <br />project will be paid by the applicant. The Director <br />of Public Utilities may require the applicant to <br />provide studies documenting projected City water <br />requirements. <br /> <br />(j) <br /> <br />If any condition of this use permit is for any <br />reason declared invalid by a court of law, such <br />decision shall not affect the validity and <br />enforceability of the remaining conditions. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia, at a meeting held March 27, 1990. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
