(f) If violations of the conditions of this use permit occur, the City Manager of the City of Portsmouth or his designee shall be empowered to require that operation of the facility, or any part thereof, be discontinued until proper corrective action has been taken. (g) Facility shall be constructed and operated in accordance with document entitled "CGX Environmental Systems of Portsmouth, Inc., Project Summary", submitted by the applicant, unless otherwise modified by conditions contained herein or by an alternate acceptable to the Council of the City of Portsmouth. (h) No deliveries of solid wasze will be permitted between the hours of 6:30 and 7:30 a.m. and between the hours of 3:45 and 4:45 p.m. The City Manager, upon recommendation by the City Traffic Engineer, may modify the terms of this condition, provided that: (1) The City Manager or his designee will provide the operator 30 days advance notice of the effective date of modification; and (2) The prohibitions against deliveries shall not extend beyond the hours between 6:00 and 9:00 a.m. and between 3:30 and 6:30 p.m. (i) The cost of any improvements or modifications to public waterlines, sanitary sewerage or sewage treatment facilities directly generated by this project will be paid by the applicant. The Director of Public Utilities may require the applicant to provide studies documenting projected City water requirements. (j) If any condition of this use permit is for any reason declared invalid by a court of law, such decision shall not affect the validity and enforceability of the remaining conditions.
