UP-90-14 <br /> <br />Beginning at the southeast intersection of the <br />right-of-way lines of Median Circle and Median Court; <br />thence southeast along the south right-of-way line of <br />Median Circle, 102.22'; thence southwest 89.60'; thence <br />northwest 107.29' to the east right-of-way line of <br />Median Court; thence northeast along said right-of-way <br />line 97.12' to the south Fight-of-way line of Median <br />Circle, the point of beginning. <br /> <br />3. That the use permit is approved subject to the <br /> following conditions: <br /> <br />(a) The maximum number of children enrolled in the <br /> day-care center shall be nine (9). <br /> <br />(b) <br /> <br />The applicant shall provide an outdoor play <br />area as shown on Exhibit 1, attached hereto <br />and made a part hereof. The recreational play <br />area shall contain a minimum of 4000 square <br />feet and be enclosed by a 42" high chain link <br />fence. Design of the fence must be approved <br />by the Planning Department prior to <br />installation. <br /> <br />(c) Ail outdoor activities shall be conducted <br /> between the hours of 8:00 a.m. and 6:00 p.m. <br /> <br />(d) Ail indoor activities shall be conducted <br /> between the hours of 6:00 a.m. and 6:00 p.m. <br /> <br />(e) <br /> <br />The applicant shall comply with all applicable <br />codes, ordinances, policies and regulations of <br />federal, state and local governments and shall <br />obtain all necessary licenses and permits. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia, at a meeting held November 27, 1990. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
