64 A RESOLUTION GRANTING A USE PERMIT TO WHEELABRATOR TECHNOLOGIES, INC. FOR THE OPERATION OF A GARBAGE AND WASTE INCINERATOR AT 1141 VICTORY BOULEVARD, PORTSMOUTH, VIRGINIA. WHEREAS, Wheelabrator Technologies, Inc.. has made application pursuant to Section 40-69(b) of the Code of the City of Portsmouth, Virginia, 1988, for the granting of a use permit as hereinafter described; and WHEREAS, the applicant and the done all things required to be done application; and Planning Director have in connection with said WHEREAS, the Planning Commission has recommended the granting of said use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth,.Virglnla, that: 1. The use for which the use permit hereinafter described is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to the property or improvements of the neighborhood; and (c) Will be in accordance with the purposes of the Zoning Chapter of the City Code. 2. Wheelabrator Technologies, Inc. is hereby granted a use permit pursuant to Section 40-69(b) of the Code of the City of Portsmouth, Virginia, 1988, for the operation of a garbage and waste incinerator on property located at 1141 Victory Boulevard, Portsmouth, Virginia and being more particularly described as: UP-99-13 Beginning at the intersection of the Portsmouth-Chesapeake corporate boundary and the east right-of-way line of Victory Boulevard; thence northeasterly along the east right-of-way line of Victory Boulevard 1,770'~ to a point; thence easterly 640'+ to the western line of Paradise Creek; thence--in a southerly and easterly direction
