UP-9t-09 <br /> <br />Beginning on the west right-of-way of Cavalier Boulevard <br />170' more or less north from its intersection with the <br />north right-of-way of Tazewell Street; thence west 150' <br />to a point; thence north 150' to a poiat; thence east <br />150' to the west ~ight-of-way of Cavalier Boulevard; <br />thence south along said right-of-way 150' to the point of <br />beginning. <br /> <br />That the use permit is approved subject to the <br />following conditions: <br /> <br />(a) <br /> <br />The facility shall be developed as shown on <br />Exhibits A and B, attached hereto and made a <br />parn hereof. <br /> <br />(b) <br /> <br />Security lights shall be installed and <br />maintained at the rear of the building - out of <br />normal reach, and shall De operated with a dusk <br />to dawn timer. <br /> <br />(c <br /> <br />Panic bars shall be installed and maintained on <br />the exit doors. <br /> <br />(d <br /> <br />No more than 42 children shall attend the <br />facility. <br /> <br />(e <br /> <br />The applicant must fully enclose the outdoor <br />play area with a wood privacy fence at least <br />six feet in height. <br /> <br />(f <br /> <br />Ail outdoor operations shall be conducted <br />between the hours of 8:00 a.m. and 8:30 p.m. <br /> <br />(g) The facility shall be inspected annually by the <br /> City Fire Department, the City Health <br /> Department, and the City Fire Marshal. <br /> <br />(h) <br /> <br />The applicant shall comply with all applicable <br />codes, ordinances, and regulations of federal, <br />state and local governments and shall obtain <br />all necessary licenses and permits. <br /> <br />(±) <br /> <br />If the contract purchaser fails to obtain legal <br />title to 1220 Cavalier Boulevard, Portsmouth, <br />Virginia, this use permit shall become invalid <br />and thereby revoked. <br /> <br />(j) <br /> <br />The applicant shall obtain approval from the <br />City Engineer and/or Planning Director of a <br />plan for the necessary parking, driveway, and <br />curb cuts. <br /> <br /> <br />
