UP-91-06 <br /> <br />Beginning at a point on the west right-of-way of Cedar <br />Lane 125' more or less north from its intersection with <br />Leslie Drive; thence westerly 289.99'; thence <br />northwesterly 500.33'; thence northeasterly 165'; thence <br />southeasterly 305.15'; thence easterly 339.25' to the <br />west right-of-way of Cedar Lane; thence southerly along <br />said right-of-way 250' to the point of beginning. <br /> <br />That the use permit is approved subject to the <br />following conditions: <br /> <br />(a) The maximum number of children enrolled in the <br /> day-care center shall be forty-five (45). <br /> <br />(b) <br /> <br />The applicant shall provide an outdoor play <br />area as shown on Exhibit 1, attached hereto and <br />made a part hereof. The recreational play area <br />shall be enclosed with a fence at least <br />forty-two (42) inches in height. <br /> <br />(c) <br /> <br />Ail outdoor activities shall be conducted <br />between the hours of 8:00 a.m. and 6:00 p.m. <br /> <br />(d) <br /> <br />Ail indoor activities shall be conducted <br />between the hours of 6:00 a.m. and 6:00 p.m. <br /> <br />(e) <br /> <br />The facility shall be inspected annually by the <br />City Fire Department, the City Health <br />Department, and the State and City Fire <br />Marshall. <br /> <br />(f) <br /> <br />In the event that the outdoor play area <br />required in (bi ~bove is converted to parking <br />or any other use, a new site layout plan must <br />be submitted to the Planning Commission for <br />approval. The use permit shall become void if <br />a new site layout plan is not approved. <br /> <br />(g) <br /> <br />The applicant shall comply with all applicable <br />codes, ordinances, and regulations of federal, <br />state and local governments and shall obtain <br />all necessary licenses and permits. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia, at a meeting held May 28, 1991. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
