16 <br /> <br />A RESOLUTION GRANTING A SPECIAL EXCEPTION TO CENTRAL FIDELITY <br />BANK FOR PROPERTY AT 311 COUNTY STREET FOR OFF-STREET PARKING <br />IN THE DOWNTOWN D-1 DISTRICT MIXED USE SUBDISTRICT. <br /> <br /> WHEREAS, Central Fidelity Bank has made application for <br />the granting of a special exception to the off-street parking <br />requirements for Building No. 3 of the Bristol Square Office <br />Complex pursuant to Section 40-121(b)(iv) in the Downtown D-1 <br />District Mixed Use Subdistrict; and <br /> <br /> WHEREAS, the applicant and the <br />done all things required to be done <br />application; and <br /> <br />Planning Director have <br />in connection with said <br /> <br /> WHEREAS, the Planning Commission has made a <br />recommendation for the granting of a special exception to <br />off-street parking requirements. <br /> <br />the <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia, that: <br /> <br />1. The special exception to be granted: <br /> <br /> (a) Will not adversely affect the health and safety <br />of persons residing or working in the neighborhood; <br /> <br /> (b) Will not be detrimental to the public use or <br />in3urious to the property or improvements in the <br />neighborhood; and <br /> <br /> (c) Will be in accordance with the purposes and <br />objectives of the Downtown D-1 District and the Zoning <br />Chapter of the City Code. <br /> <br /> 2. Central Fidelity Bank and any sucessor is hereby <br />granted a special exception to the off-street parking <br />requirements in the Downtown D-1 District Mixed Use <br />Subdistrict as provided ~or in Section 40-121(b)(iv) for the <br />property known as Building No. 3 of the Bristol Square Office <br />Complex located at 311 County Street by the granting of a <br />waiver of seventeen (17) of the required parking spaces for <br />the operation of an office building and accessory uses, such <br />special exception being approved subject to the following <br />conditions: <br /> <br /> (a) The special exception is expressly conditioned <br />upon the continued use of the property for an office <br />building and accessory uses, and any change from such use <br />shall cause the special exception hereby granted to be <br />terminated. <br /> <br /> <br />
