15 A RESOLUTION GRANTING A USE PERMIT TO COMMERCE BANK TO OPERATE A STORAGE WAREHOUSE AT 4715 PORTSMOUTH BOULEVARD. WHEREAS, Commerce Bank has made application pursuant to Section 40-71(b) of the Code of the City of Portsmouth, Virginia, 1988, as amended, to operate a storage warehouse at 4715 Portsmouth Boulevard, said property being more particularly described below; and WHEREAS, the Planning Commission has recommended the conditional granting of a use permit for the operation of a storage warehouse. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit is sought: (a) Will not adversely affect the health and of persons residing or working in the neighborhood of the proposed use; and safety (b) Will not be detrimental to the public use or injurious to the property and improvements of the neighborhood; and (c) Will be in accordance with the purposes of the Zoning Chapter of the City Code. 2. That Commerce Bank is hereby granted a use permit pursuant to ~40-71(b) of the Code of the City of Portsmouth, Virginia, 1988, as amended, to operate a storage warehouse on property located at 4715 Portsmouth Boulevard, such area being more particularly described as follows: UP-91-3 Beginning on the south right-of-way of Portsmouth Boulevard at a point 1,387.30'+ east from its intersection with the east rig~t-of-way of City Park Avenue; thence southwest 51.95'; thence easterly 2.80'; thence southwest 34.16'; thence easterly 14.77'; thence southwest 41.82'; thence southerly 34.42'; thence easterly 28.27'; thence north 56.91'; thence northeast 107.20' to the south right-of-way of Portsmouth Boulevard; thence westerly along said right-of-way 37.56' to the point of origin.
