A RESOLUTION TO VACATE AND RELEASE A STORM DRAINAGE EASEMENT <br />ON THE NORTH SIDE OF SOUTH STREET BETWEEN NOTTOWAY AVENUE AND <br />RODMAN AVENUE. <br /> <br /> WHEREAS, Alton F. Catlett is the owner of lots located on <br />the north side of South Street, lying between Nottoway Avenue <br />and Rodman Avenue; and <br /> <br /> WHEREAS, said lots were encumbered by a storm drainage <br />easement as set forth in an agreement dated September 30, <br />1977, duly recorded in the Clerk's Office of the Circuit Court <br />for the City of Portsmouth in Deed Book 717 at page 517; and <br /> <br /> WHEREAS, the said Alton F. Catlett has made application <br />to vacate and release the interest of the City of Portsmouth <br />acquired in said agreement; and <br /> <br /> WHEREAS, the Council of the City of Portsmouth, Virginia <br />has determined that said easement is not one dedicated to use <br />as a public way, and there is no further use for said easement <br />by the City of Portsmouth. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia, that the City Manager be, and he <br />hereby is, authorized to convey, quit-claim and release the <br />hereinafter-described interest of the City of Portsmouth in <br />the property encumbered thereby, to-wit: <br /> <br /> Ail right, title and interest to the City <br />of Portsmouth to construct, renew and repair <br />storm sewer pipes and/or lines under and across <br />a certain parcel of land situate in the City of <br />Portsmouth, Virginia, described as follows: <br /> <br /> Beginning at the northwestern right-of-way <br />intersection of Rodman Avenue and South Street; <br />thence along the existing northern ri~ht-of-way <br />of South Street N 86° 36' 00" W a distance of <br />112.50' to the True Point of Beginning; thence N <br />86° 36' 00" W a distance of 15.00' to a point; <br />thence N 3° 24' 00" E a distance of 93.50' to a <br />point; thence N 86° 36' 00" W a distance of <br />82.50' to a point; thence N 3° 24' 00" E a <br />distance of 15.00' to a point; thence S 86° 36' <br />00" E a distance of 97.50' to a point; thence S <br />3° 24' 00" W a distance of 108.50' to the True <br />Point of Beginning, as shown on that certain <br />plat entitled "15' Drainage Easement Acquired <br />From George C. Norris, Sr. & E. A. Morgan", <br />dated September 8, 1977 and prepared by <br />Engineering & Technical Services, City of <br /> <br /> <br />
