72 <br /> <br />A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A <br />VACATION FOR A PORTION OF A DRAINAGE EASEMENT IN THE <br />BRIGHTON/SOUTH PORTSMOUTH PROJECT ~0 JEAN M. DAVIS. <br /> <br />DEED OF <br /> <br /> WHEREAS, Jean M. Davis conveyed to the City of Portsmouth <br />an easement for installation of storm drainage pipes and lines <br />by deed dated April 27, 1989, duly recorded in the Clerk's <br />Office of the Circuit Court of the City of Portsmouth in Deed <br />Book 1034 at page 920; and <br /> <br /> WHEREAS, subsequent installation of the pipeline revealed <br />that a portion of said easement was unusable; and <br /> <br /> WHEREAS, Jean M. Davis has since agreed to convey in fee <br />to the City of Portsmouth a parcel of land for installation of <br />said pipeline which includes the needed portion of the <br />easement previously conveyed; and <br /> <br /> WHEREAS, the City of Portsmouth desires to release and <br />vacate the unneeded portion of the easement. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia, that the City Manager be, and he <br />hereby is, authorized to execute such document, or documents <br />as may be necessary to vacate and release a portion of the <br />easement granted to the City of Portsmouth by deed of Jean M. <br />Davis duly recorded in the Clerk's Office of the Circuit Court <br />of the City of Portsmouth, Virginia in Deed Book 1034 at page <br />920, the portion to be vacated and released being described as <br />"Existing Easement Area To Be Vacated" as shown on that <br />certain plat entitled "Plat Showing Property To Be Acquired <br />From Jean M. Davis For Right-Of-Way Purposes", which said plat <br />shall be made a part of said documents of vacation and <br />release, and shall be recorded with same. <br /> <br /> Adopted by the Council <br />Virginia, at a meeting held <br /> <br />of the Cihy-of Portsmouth, <br />on November 26, 1991. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
