1991-98 <br /> <br />AN ORDINANCE TO AMEND CHAPTER 9.1 OF THE CODE OF IHE CITY OF <br />PORTSMOUTH, VIRGINIA, BY AMENDING SECTIONS 9.1-3, <br />9.1-10(b)(1)a., 9.1-10(b)(3) AND 9.1-13(a) THEREOF, PERTAINING <br />TO THE CHESAPEAKE BAY PRESERVATION AREA OVERLAY DISTRICT. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Section 9.1-3 of the Code of the City of <br />Portsmouth, Virginia, 1988, be amended by adding the <br />definition "Public Road" thereto to read as follows: <br /> <br />Section 9.1-3. Definitions. <br /> <br /> "Public Road" means a publicly-owned road designed and <br />constructed in accordance with water quality protection <br />criteria at least as stringent as requirements applicable to <br />the Virginia Department of Transportation, including <br />regulations promulgated pursuant to (i) the Erosion and <br />Sediment Control Law (Sections 10.1-560, et seq., of the Code <br />of Virginia) and (ii) the Virginia Stormwater Control Law <br />(Sections 10.1-603, et seq., of the Code of Virginia). This <br />definition includes those roads where the Virginia Department <br />of Transportation exercises direct supervision over design <br />and/or construction activities, and those secondary roads <br />which are constructed and/or maintained by the City in <br />accordance with applicable code and construction requirements. <br /> <br /> 2. That Section 9.1-10(b)(1)a. of the Code of the City <br />of Portsmouth, Virginia, 1988, be amended to read as follows: <br /> <br />Section 9.1-10. Performance Standards. <br /> <br />(b) General Performance Standards. for Development and <br /> Redevelopment in Chesapeake Bay Preservation Areas: <br /> <br />(1) Land disturbance shall be limited to the area <br /> necessary to provide for the desired use or <br /> development. <br /> <br />In accordance with an approved site plan, <br />the limits of land disturbance, including <br />clearing or grading shall be defined by <br />the construction footprint and approved <br />landscaping. These limits shall be <br />clearly shown on submitted plans and <br />physically marked on the development site. <br /> <br /> 3. that Section 9.1-10(b)(3) of the Code of the City of <br />Portsmouth, Virginia, 1988, be amended to read as follows: <br /> <br /> <br />
