AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, 1988 AS AMENDED, BY ADDING ARTICLE IV TO CHAPTER 16 <br />THEREOF PERTAINING TO SOLID WASTE. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Chapter <br />Portsmouth, Virginia, <br />Article IV to read as <br /> <br />16 of the Code of the City of <br />as amended, be amended by adding <br />follows: <br /> <br />thereto <br /> <br />ARTICLE IV. Solid Waste. <br /> <br />Section 16-161. Definitions. <br /> <br /> Unless a different meaning is required by the context, <br />the following terms as used in this article shall have the <br />meanings as respectively ascribed to them in this section. <br /> <br /> (a) Person means: any nonresidential generator of solid <br />waste and any company, business or other party which collects, <br />transports, processes or recycles solid waste. <br /> <br /> (b) Solid Waste means: any garbage, refuse, sludge and <br />other discarded material, including solid, liquid, semi-solid <br />or contained gaseous material, resulting from industrial, <br />commercial, residential, mining and agricultural operations, <br />or community activities but does not include: (1) solid or <br />dissolved material in domestic sewage, (2) solid or dissolved <br />material in irrigation return flows or in industrial <br />discharges which are sources subject to a permit from the <br />State Water Control Board, or (3) source, special nuclear, or <br />by-product material as defined by the Federal Atomic Energy <br />Act of 1954, as amended. <br /> <br /> (c) Recycle means: (1) to sell, donate, or otherwise <br />transfer solid waste material to any other person located <br />outside of the City of Portsmouth so that such waste material <br />may be processed and used again as raw material for a product <br />which may or may not be similar to the original product; or <br />(2) to process a given waste material at a location within the <br />City of Portsmouth so that such material may be used again as <br />a raw material for a product which may or may not be similar <br />to the original product. <br /> <br />Section 16-162. <br /> <br />Solid Waste; Annual Recycling Reports <br />Required. <br /> <br /> (a) Any person located within the City who recycles <br />solid waste shall submit an annual report to the Director of <br />General Operations of the City of Portsmouth or his designee. <br /> <br /> <br />
