ARTICLE V. SIGNS See. 40-60. Purl~ose. The purposes of these sign regulations are: to encourage the effective use of signs as a means of communication in the City; to maintain and enhance the aesthetic environment and the city's ability to attract sources of economic development and growth; to improve pedestrian and traffic safety; to mir. imize the possible adverse effect of signs on nearby public and private property; and to enable the fair and consistent enforcement of these sign restrictions. This sign ordinance Es adopted under the zoning authority of the city in furtherance of the more general purposes set forth in the zoning ordinance. Sec. 40-61. Applicability. Signs shall be permitted accordance with this Article. on private property in the City of Portsmouth in Sec. 40-61.1. Sign types and districts. Signs shall be permitted in the various zoning districts in accordance with Tables 40-61.1-1 and 40-61.1-2, hereby adopted, and subject to the applicable conditions indicated in the "Conditions" column for each sign type on the table. Signs labeled with a "P" for a district or group of districts are permitted in the district without further city approval, subject to the indicated conditions. A sign labeled with a "CC" for a district is permitted in the district upon the issuance of a Certificate of Compliance by the zoning administrator, subject to the indicated conditions. A sign labeled with a "UP" for a district is conditionally permitted in the district, subject to the issuance of a use permit by city council and subject to the indicated conditions. A sign labeled with "NP" for a district is not permitted in the district. Signs in Downtown and Historic Districts require review by the appropriate commission of architectural review or downtown design committee. As used in this paragraph, "a district" includes a group of districts where applicable, according to the Table. Sec. 40-61.2. Sign conditions supplement to tables 40-61.1-1 and 40-61.1-2. The following conditions apply to the specified signs and districts as indicated in the "condition" column of Tables 40-61.1-1 and 40-61.1-2: (1) (2) BANNER SIGNS shall be subject to the general regulations. CHANGEABLE COPY signs shall not be considered to be animated or flashing simply because the copy is changed electrically or electronically. Changing time and temperature or stock market indicator signs shall be considered changeable copy signs. 87
