(c) <br /> <br />In addition to any penalty imposed for a violation <br />of (a) (1) through (a) (4) above, the Court, hearing <br />the case, may direct the person responsible for the <br />discharge or deposit to remediate or remove such <br />discharge or deposit, and each day's default in such <br />remediation or removal shall constitute a violation <br />of and a separate offense under this section. <br /> <br />Section 31.1-4. Notice to correct drainage. <br /> <br />(a) <br /> <br />Whenever the director shall find that a tract of <br />land is inadequately drained, or that there is an <br />obstruction to a culvert, drain, or other natural or <br />man-made watercourse that interferes with stormwater <br />naturally flowing therein or that such culvert, <br />drain, or watercourse is of insufficient capacity to <br />reasonably accommodate the flow of stormwater, the <br />director or a person designated by the director <br />shall notify the owner or person having possession, <br />charge, or management of such land to remove the <br />obstruction or provide the necessary drainage. <br /> <br />(b) <br /> <br />The owner or person having possession, charge or <br />management of the land in question must comply with <br />the director's order within the time specified in <br />the notice. Failure to comply with such order shall <br />constitute a violation of this chapter. In addition <br />to any penalty imposed for each violation, the Court <br />hearing the case may direct the person responsible <br />for the obstruction to remediate or correct the <br />obstruction, and each day's default in such <br />remediation or correction shall constitute a <br />violation of and a separate offense under this <br />section. <br /> <br /> 2. That Article II of Chapter 31.1 of the Code!of the <br />City of Portsmouth, Virginia, 1988, pertaining to stormwater <br />management be, and the same hereby is added, to read as <br />follows: <br /> <br />ARTICLE II. STORMWATER UTILITY <br /> <br />Section 31.1-50. Authority. <br /> <br /> The city is authorized by the provisions of Virginia Code <br />Title 15.1, and the Constitution of the Commonwealth of <br />Virginia to construct, reconstruct, improve and extend the <br />stormwater system, establish utility charges, and to issue <br />bonds and other debts as needed to finance in whole or in part <br />the costs of the system and to establish rents, fees and <br />charges for the services and facilities provided by the <br />system. <br /> <br /> <br />
