1992-84 <br /> <br />AN ORDINANCE TO AMEND CHAPTER 16 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA, 1988, BY AMENDING SECTIONS 16-1, <br />16-32(b), 16-38, 16-62(a), 16-65(a), AND 16-68 THEREOF, AND BY <br />ADDING SECTIONS 16-32(d), 16-66 AND 16-70 THERETO, PERTAINING <br />TO GARBAGE AND REFUSE. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Sections 16-1, <br />16-68 of the Code of the City <br />be amended to read as follows: <br /> <br />16-38, 16-62(a), 16-65(a), and <br />of Portsmouth, Virginia, 1988, <br /> <br />Section 16-1. <br /> <br />Definitions. <br /> <br /> Business or commercial establishments: The term <br />"business or commercial establishments" are premises wherein: <br /> <br />(1) There is carried on any business, profession or <br /> occupation subject to the license tax ordinance of <br /> the city; or <br /> <br />(2) <br /> <br />There is carried on any broadcasting, publishing, <br />manufacturing or commercial activity or process, <br />including the renting of residential property; or <br /> <br />(3) There are multi-family units of four (4) or more <br /> including condominium units. <br /> <br />Section 16-38. <br /> <br />Receptacles from multifamily structures to <br />be identifiable. <br /> <br /> Every rental dwelling unit shall be supplied with <br />approved containers and covers for the storage of refuse and <br />garbage, and the owner, operator or agent in control of such <br />dwelling unit shall be responsible for supplying the necessary <br />number of containers per residential dwelling unit and for <br />marking on the receptacle the number of the residential <br />dwelling unit that uses that specific receptacle. <br /> <br />Section 16-62. Exemptions. <br /> <br /> (a) The director may exempt a business or commercial <br />establishment from the payment of the service charges <br />prescribed by this division upon receipt of a written request <br />therefor, if the establishment has an alternate method of <br />transporting and disposing of garbage and refuse that is <br />acceptable to the director. <br /> <br />Section 16-65. Rates for standard containers. <br /> <br /> (a) Where garbage and refuse are stored in thirty-two <br />(32) gallon containers or properly sealed plastic or <br /> <br /> <br />
