Parking in spaces reserved for handicapped <br /> persons. <br /> <br /> (a) It shall be unlawful for a n~Dhandicapped driver of <br />a motor vehicle to park in a parking space reserved for the <br />handicapped at privately owned shopping centers, business <br />offices, or parking lots or on the streets or public grounds <br />of the city, unless such driver is using the motor vehicle to <br />transport a handicapped person who has obtained a special <br />vehicle parking permit from the commissioner of the state <br />department of motor vehicles. Pot purposes of this section, <br />the term "nonhandicapped driver" shall mean the driver of a <br />motor vehicle who has not been issued a license plate, permit, <br />or decal by the commissioner designating such person as <br />handicapped. The license plate issued by the commissioner to <br />a motor vehicle shall be attached to such motor vehicle as <br />required by Section 22-114. The decal or permit issued by the <br />commissioner must be displayed in the front windshield of the <br />motor vehicle when such vehicle IS parked in a parking space <br />reserved for the handicapped. Spaces reserved for the <br />handicapped shall be identified in accordance with the <br />provisions of Section 36-99.10 of the Code of Virginia. <br /> <br /> 2. That Chapter 22 of the Code of the City of <br /> Portsmouth, Virginia, 1988, be amended by adding thereto <br /> Section 22-398.1 to read as follows: <br /> <br /> Section 22-398.1. Decreased maximum speed limits in highway <br /> work zones. <br /> <br /> Operation of any motor vehicle in excess of a maximum <br />speed limit established specifically for a highway work zone, <br />when workers are present and when such highway work zone is <br />indicated by appropriately placed signs displaying the reduced <br />maximum speed limit and the penalty for violations, shall be <br />unlawful and constitute a traffic infraction punishable by a <br />fine of not more than $250.00. <br /> <br /> For the purposes of this section, "highway work zone" <br />means a construction or maintenance area that is located on or <br />beside a highway and marked by appropriate warning signs or <br />other traffic control devices indicating that work is in <br />progress. <br /> <br /> Nothing in this section shall preclude the prosecution or <br />conviction for reckless driving of any motor vehicle operator <br />whose operation of any motor vehicle in a highway work zone, <br />apart from speed, demonstrates a reckless disregard for life, <br />limb, or property. <br /> <br /> <br />
