49 <br /> <br />A RESOLUTION OF THE COUNCIL OF THE CITY OF PORTSMOUTH, <br />VIRGINIA EXPRESSING ITS INTENT TO CLOSE, VACATE, ABANDON AND <br />RELEASE ALL PUBLIC RIGHTS-OF-WAY AND OTHER PUBLIC RIGHTS AND <br />INTERESTS WITHIN THE AREA OF THE PROPOSED HORSE RACING TRACK.' <br /> <br /> WHEREAS, the citizens of the City of Portsmouth by <br />overwhelming vote have by referendum shown public support for <br />a horse racing track in the City of Portsmouth, Virginia; and <br /> <br /> WHEREAS, the Council o~ the City of Portsmouth, Virginia, <br />acting in acccrd with the expressed desire of its citizens, <br />has authorized its City Manager to enter into an agreement of <br />intent for the construction of said track; and <br /> <br /> WHEREAS, there are located within the boundaries of the <br />proposed track site, public rights-of-way and other public <br />rights and interests which must be closed, vacated, abandoned <br />and released in order that the track may be constructed. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED that the Council of the <br />City of Portsmouth, Virginia, hereby expresses and makes known <br />its intent to close, vacate, abandon and release, in such <br />manner as prescribed by law any and all public rights-of-way, <br />public rights and interests as may be necessary for the <br />construction and establishment of a horse racing track in that <br />area as shown on the attached exhibit, with such action to be <br />taken at such time as the Virginia Racing Commission grants a <br />license for said track to Virginia Racing Associates, and only <br />after title to said area has vested in the Portsmouth <br />Redevelopment and Housing Authority. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia, at a meeting held on September 28, 1993. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
