40 <br /> <br />A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING USE PERMIT <br />(GHP-93-3) TO PERMIT CONSTRUCTION OF 160 CONDOMINIUM UNITS ON <br />RIVER POINTE PARKWAY ON A PORTION OF TAX MAP 709~ PARCEL 1.2. <br /> <br /> WHEREAS, the applicant, River Pointe Associates, LoLoCo, <br />has made application pursuant to Section 40-112 of the Code of <br />the City of Portsmouth, Virginia, 1988, as amended, for the <br />approval and granting of a group housing use permit for the <br />construction of 160 condominium units on River Pointe Parkway <br />on a portion of Tax Map 709, Parcel 1.2, more particularly <br />described as follows: <br /> <br />GHP-93-3 <br /> <br /> Beginning at the southwest intersection of River <br />Pointe Parkway and River Pointe Drive; thence west along <br />the south right-of-way line of River Pointe Drive 305' <br />more or less to s point; thence westerly along said <br />right-of-way 373.86' no a point; thence continuing <br />southwesterly along said right-of-way 80' more or less no <br />a point; thence southeasterly 502' more or less to a <br />point; thence southwesterly 27' more or less no a point; <br />thence southeasterly 175' more or less to a point; thence <br />southeasterly 100' more or less to a point; thence <br />easterly 95' more or less to a point; thence <br />northeasterly 195' more or less to a point; thence <br />easterly 100' more or less to the west right-of-way line <br />of River Pointe Parkway; thence north along said <br />right-of-way 615' more or less to River Pointe Drive, the <br />point of origin. <br /> <br /> WHEREAS, the planning commission has reviewed such <br />application and site plan submitted therewith and has <br />re.commended conditional approval of said application; <br /> <br /> WHEREAS, the applicant has been informed that approval of <br />the group housing project pursuant to section 40-116 grants <br />only an exemption from certain requirements for residences as <br />stated in said section and does not constitute a waiver of any <br />other requirement embodied in the Subdivision Ordinance, <br />Zoning Ordinance, Code of th~ City of Portsmouth, Virginia, or <br />any other applicable local, state or federal law or <br />regulation; and <br /> <br /> WHEREAS, the applicant is aware that building permits or <br />any other required permit will be issued only upon compliance <br />with the ordinances, laws or regulations applicable thereto. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia: <br /> <br /> 1.
