UP-93-7 <br /> <br />Beginning at the southwest intersection of Ann and Owens <br />Streets~ thence south along the west right-of-way of <br />Owens Street to the south right-of-way line of Blair <br />Street; thence west 7' more or less to a point; thence <br />southwest 107.13' to a northern boundary line of Oak <br />Grove Cemetery; thence northwest 50' to a point; thence <br />west 70' more or less to a point; thence north 80.06' to <br />a point; thence northwest 65' more or less to a point; <br />thence west 62' more or less to a point; thence northwest <br />155' more or less to a point; thence west 65' more or <br />less to a point; thence northerly 120' to a point; thence <br />east a distance of 375' more or less to the southwest <br />intersection of Ann and Owens Streets, the point of <br />origin. <br /> <br />3. That the use permit is approved subject to the <br /> following conditions: <br /> <br />(1) <br /> <br />The applicant shall provide at least <br />thirty-four (34) off-street parking spaces. <br />These spaces may be provided on-site or <br />off-site, on City-owned property, as shown <br />Exhibit A, attached hereto and made a part <br />hereof. <br /> <br />on <br /> <br />(2) <br /> <br />If the required parking includes off-site <br />spaces, the applicant shall enter into a lease <br />or other agreement for the spaces, which <br />instrument shall be in a form approved by the <br />City Attorney. The lease or agreement shall be <br />recorded in the office of the Clerk of the <br />Circuit Court for the City of Portsmouth prior <br />to issuance of a building permit. <br /> <br />(3) <br /> <br />If off-site parking is used to meet the parking <br />requirements, the use permit shall become void <br />if the parking agreement ls ever terminated. <br />The use permit shall not terminate, however, <br />if within sixty (60) days of termination of the <br />agreement, a substitute agreement is presented <br />to and approved by the City Attorney or if <br />construction of the requisite number of spaces <br />is cow~enced on-site. <br /> <br />(4) <br /> <br />Ail improvements shall be constructed in <br />accordance with Exhibit A. <br /> <br />(5) <br /> <br />The applicant shall comply with all applicable <br />codes, ordinances, and regulations of federal, <br />state and local governments and shall obtain <br />all necessary licenses and permits. <br /> <br /> <br />
