29 <br /> <br />A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING USE PERMIT <br />(GHP-93-1) TO PERMIT CONSTRUCTION OF EIGHTY (80) APARTMENT <br />UNITS ON GATEWAY DRIVE ON A PORTION OF TAX MAP 846, PARCEL <br />3.4. <br /> <br /> WHEREAS, the applicants, Newman Associates, have made <br />application pursuant to Section 40-112 of the Code of the City <br />of Portsmouth, Virginia, 1988, as amended, for the approval <br />and granting of a group housing use permit for the <br />construction of eighty (80) apartment units on Gateway Drive <br />on a portion of Tax Map 846, Parcel 3.4, more particularly <br />described as follows: <br /> <br />GHP-93-t <br /> <br />ALL THAT certain lot, piece or parcel of land, with <br />the appurtenances thereto, situate in the City of <br />Portsmouth, Virginia, being shown as PARCEL lB-3 on <br />that certain plat, consisting of two (2) Sheets, <br />entitled "SUBDIVISION OF PARCEL lB TOWNE POINT <br />PLAZA," dated August 1, 1989, prepared by Horton & <br />Dodd, P.C. and duly recorded in the Clerk's Office of <br />the Circuit Court of the City of Portsmouth, <br />Virginia, in Map Book 15 at page 17; said PARCEL lB-3 <br />containing 5.5308 acres situate on the south side of <br />Gateway Drive, and of the dimensions shown on said <br />plat; and <br /> <br /> WHEREAS, the Planning Commission has reviewed such <br />application and site plan submitted therewith and has <br />recommended conditional approval of said application; and <br /> <br /> WHEREAS, the developer has been informed that approval of <br />the group housing project pursuant to Section 40-116 grants <br />only an exemption from certain requirements for residences as <br />stated in said section and does not constitute a waiver of any <br />other requirement embodied in the Subdivision Ordinance, <br />Zoning Ordinance, Code of the City of Portsmouth, Virginia, or <br />any other applicable local, state or federal law or <br />regulation; and <br /> <br /> WHEREAS, the developer is aware that building permits or <br />any other required permit will be issued only upon compliance <br />with the ordinances, laws or regulations applicable thereto. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia: <br /> <br /> t. That coupled with the terms imposed by paragraph ~2 <br />herein the following conditions exist: <br /> <br />(a) The proposed pro3ect is compatible with <br /> surrounding land uses; <br /> <br /> <br />
