AN ORDINANCE TO AMEND CHAPTER 22 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA, 1988, BY ~4ENDING SECTIONS 22-7 AND <br />22-752 (g) AND (h) AND BY REPEALING SECTION 22-751 THEREOF, <br />PERTAINING TO MOTOR VEHICLE ACCIDENTS AND THE DRIVER <br />IMPROVEMENT PROGRAM. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Sections 22-7 and 22-752(g) and (h) of the Code <br />of the City of Portsmouth, Virginia, 1988, be amended to read <br />as follows: <br /> <br />Section 22-7. <br /> <br />Driver Improvement Program. <br /> <br /> (a) There is hereby established the City Driver <br />Improvement Program, to be directed and conducted by the <br />Portsmouth General District Court for the purpose of giving <br />instruction concerning laws and ordinances for the regulation <br />of vehicular traffic, safe operation of vehicles and other <br />related subjects. The court may, in its discretion, conduct <br />the program in conjunction with the Southeastern Virginia <br />Alcohol Safety Action Program. Instruction shall be conducted <br />at such times and dates as may be approved by the court. <br />Instructors shall include personnel from the Southeastern <br />Virginia Alcohol Safety Action Program or such other groups or <br />individuals as may be approved by the court. <br /> <br /> (b) In lieu of or in addition to the penalties <br />prescribed, any person found guilty of violation of any of the <br />provisions of this chapter may be required by the Portsmouth <br />General District Court to attend the Driver Improvement <br />Program, which shall consist of ten (10) hours of instruction <br />to be provided by sworn police officers or certified defensive <br />driver instructors. <br /> <br /> (c) The fee for such instruction shall be fifty dollars <br />($50.00) per referral. <br /> <br />Section 22-752. <br /> <br />Duties of drivers and passengers when <br />property damaged. <br /> <br /> (g) Any person convicted of violating this section shall <br />be guilty of a Class 1 misdemeanor; provided, however, that if <br />the vehicle or other property struck is unattended and the <br />damage thereto is less than two hundred fifty dollars <br />($250.00), such person shall be guilty of a Class 4 <br />misdemeanor. <br /> <br /> (h) Any person convicted of violating the provisions of <br />this section may be punished, in addition to the penalties <br />provided for such violation if such accident resulted only in <br />damage to property and such damage exceeded five hundred <br />dollars ($500.00), by revocation of his license or privilege <br /> <br /> <br />
