1993-9 <br /> <br />AN ORDINANCE TO AMEND CHAPTER 33 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA, 1988, BY AMENDING SECTION 33-32(a)(7) <br />AND BY REPEALING SECTION 33-16(17) THEREOF, PERTAINING TO <br />SIDEWALK WHEELCHAIR RAMPS IN SUBDIVISIONS. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Section 33-32(a)(7) of the Code of the City of <br />Portsmouth, Virginia, 1988, be amended to read as follows: <br /> <br />Section 33-32. Utility and street improvements. <br /> <br /> (a) In subdivisions or parts of subdivisions, <br />Improvements shall be provided as follows: <br /> <br />(7) <br /> <br />Sidewalks, at least five (5) feet in width, shall be <br />installed on both sides of all arterial and <br />collector streets. Sidewalks, at least five (5) <br />feet in width, shall be installed along all street <br />frontage planned for apartments or townhouses. <br />Sidewalks, at least four (4) feet in width, shall be <br />required along both sides of all minor and <br />cul-de-sac streets; however, the planning commission <br />may reduce the requirements on any minor street or <br />cul-de-sac where the commission finds that one or <br />more of the following criteria have been met: the <br />minor street or cul-de-sac will have ten (i0) or <br />less platted lots; or the lots will be larger than <br />one-half (1/2) acre in size~ or where natural <br />features are worthy of preservation. The commission <br />must also find that such reduction will not create a <br />pedestrian safety hazard. Sidewalks shall be <br />installed in accordance with plans and <br />specifications of the city and must include ramDs <br />for wheelchair access at all intersections in <br />accordance with the requirements of the Americans <br />with Disabilities Act and in accordance with any <br />revisions approved by the Federal ~ighway <br />Administration. Commercial or industrial <br />subdivisions may be exempted from the requirements <br />of this section if no substantial pedestrian hazard <br />will be created thereby. <br /> <br /> 2. That Section 33-16(17) of the Code of the City of <br />Portsmouth, Virginia, 1988, be repealed. <br /> <br /> 3. That this ordinance shall take effect on the date of <br />its adoption. <br /> <br /> <br />
