AN ORDINANCE TO AMEND CHAPTER 38 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA, 1988, BY AMENDING SECTIONS 38-166(b), <br />38-168(b), (c) & (d), 38-170 through 38-174, 38-179(c) (1), 38-181, <br />38-185(a), 38-186(c), and 38-187(a) PERTAINING TO WATER, SEWERS AND <br />SEWER DISPOSAL. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Section 38-166(b) of the Code of the City of <br />Portsmouth, Virginia, 1988, be amended by amending the Definitions <br />of Air Gap, Backflow and Director and by adding the definitions of <br />Backflow Preventer, Backpressure and Backsiphonage to read as <br />follows: <br /> <br /> Section 38-166. Purpose and Definitions <br /> <br />(b) Air gap: The unobstructed distance through a free atmosphere <br />between the lowest perimeter of a water outlet and the flood-level <br />rim of any receptacle. This distance shall be A minimum of two (2) <br />times the diameter of the outlet. (In case of nearwalls, this <br />distance shall be three (3) times the diameter of the outlet.) <br /> <br />Backflow: The reversal of flow from its intended direction as <br /> result of backsiphonage or backpressure. <br /> <br />Backflow Preventer: An approved assembly or device that prohibits <br />the backflow of water. <br /> <br />Backpressure: A pressure, higher than supply pressure, caused by a <br />pump, elevated tank, boiler, air/steam pressure, or any other <br />means, which may cause backflow. <br /> <br />Backsiphonage: A type of backflow caused by a negative or reduced <br />pressure in the supply piping. <br /> <br />Director: The director of the department of public utilities or <br />the director's designee. <br /> <br /> 2. That Section 38-168 (b), (c), and (d) of the Code of the <br />City of Portsmouth, Virginia, 1988, be amended to read as follows: <br /> <br />Section 38-168. Inspection to be at reasonable hours, etc.; <br />warrant <br /> to enable inspection; termination of service to <br /> uninspected premises. <br /> <br />(b) In addition to the warrant procedure set forth in subsection <br />(a) of this section, the director may commence administrative <br />proceedings to discontinue water service to uninspected premises. <br /> <br /> <br />
