AN ORDINANCE TO AMEND CHAPTER 33 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTION 33-32(A) <br />THEREOF PERTAINING TO SUBDIVISION UTILITY AND STREET <br />IMPROVEMENTS. <br /> <br />BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Section 33-32(a) of the Code of the City of <br />Portsmouth, Virginia (1988) be amended by adding thereto <br />subsection (13) to read as follows: <br /> <br />Sec. 33-32. Utility and street lmprovemenns. <br /> <br /> (a) In subdivisions or parts of subdivisions, <br />improvements shall be provided as follows: <br /> <br />(1) - (12) <br /> <br />(i3) <br /> <br />For the purpose of creating residential lots on <br />existing streets, the planning commission may modify <br />or waive the street grading, pavemen5 base, surface <br />and curb and gutter requirements on an existing <br />ssreet constructed without such required <br />improvements if: <br /> <br />The City has <br />improvements <br />ten years; <br /> <br />no plans to install such <br />on the street within the next <br /> <br />ii. The street ms currently improved or will be <br /> improved to a standard equivalent to <br /> similar streets in the neighborhood; <br /> <br />iii. <br /> <br />After consultation with the city engineer, <br />a determination is made by the planning <br />commission that the street will provide <br />adequate and safe access and drainage no <br />existing and future residents in accordance <br />with the purposes of the subdivision <br />ordinance; and <br /> <br />iv. <br /> <br />The real property for which the waiver or <br />modification is sought contains no more <br />than five (5) new, adjacent lots. <br /> <br />Any such waiver or modification shall not apply to <br />required drainage improvements except for curbs and <br />gutters. <br /> <br /> 2. That this ordinance shall cake effect on the date of <br />its adoption. <br /> <br /> <br />
