AN ORDINANCE TO AMEND CHAPTER 40 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988), BY AMENDING SECTION 40-43.4 (8) <br />AND TABLE 40-61.1-2 THEREOF AND BY ENACTING SECTION 40-177.2 <br />T~ERETO PERTAINING TO CHANGEABLE COPY SIGNS, HOME OCCUPATION <br />USE CONDITIONS, AND ADMINISTRATIVE APPEALS. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Secuion 40-43.4 (8) of the Code of the City of <br />Portsmouth, Virginia (1988), be amended and reordained to read <br />as follows: <br /> <br /> Sec. 40-43.4. Conditions for specific uses. <br /> <br /> (8) Limined to offices operated as an mncidental home <br /> occupation. Not more than twenty-five (25) percent of the total <br /> floor area in the dwelling shall be devoned no such occupancy. <br /> The use must be clearly incmdental and secondary uo the use of <br /> the dwelling purposes and must not change the character <br /> thereof. The use shall be conducted ennirely within the <br /> dwelling, and it shall be conducned enEirely by the occupants <br /> thereof, and no person who is not a resident of the dwelling <br /> shall be employed in connection with the home occupation. There <br /> shall be no display, no stock-in-trade nor commodity sold mn <br /> the dwelling in connecnion with the occupation, and there shall <br /> be no personal physical service performed in the dwelling. <br /> <br /> 2. That Table 40-61.1-2 of the Code of the City of <br /> Porusmouth, Virginia (1988), be amended and reordained to <br /> permit "Changeable Copy,, signs in the Downnown D-t-P (Public), <br /> Downtown D-2-P (Public), Downtown D-i-O (Office) and Downtown <br /> D-2-O {Office) zonmng sub-districts after mssuance of a <br /> Certifican~ of Compliance {CC) (see attached Table). <br /> <br /> 3. Than Chapter 40 of the Code of the Ciny of <br /> Pornsmouth, Virginia (1988}, be amended by adding thereno <br /> Section 40-177.2 to be ordained and read as follows: <br /> <br /> Sec. 40-177.2. Written administrativ9 decision ~ <br /> <br /> Any order, requiremenn, decision or determination by the <br />zoning administranor or by any other administrative officer in <br />the administration or enforcemenu of this ordinance shall be in <br />writing and conclude with or include the following statement: <br />~'You have thirty days from this date in which to appeal this <br />decision to the Board of Zoning Appeals, in accordance with <br />section 15.1 496.1 of the Code of the Virginia, or this <br />decision shall be final and unappealable.,, <br /> <br /> <br />
